4.75.010 Definitions.

“Business” means and includes any type of product, good, service, performance or activity which is provided or performed, or offered to be provided or performed, in exchange for money, labor, goods, or any other form of consideration.

“Contribution” means and includes any donation of money, goods, or other things of value.

“Employment” means and includes the provision of services, industry or labor performed by a person for wages or other compensation or under any contract of hire, written or oral, expressed or implied.

“Highway” means and includes the paved portion of El Camino Real within the city (including the vehicular travel lanes, parking areas, bicycle lanes), as well as the medians thereof (whether paved or planted or marked with striping).

“Solicit” means and includes any request, offer, enticement, or action which announces the availability of a person to engage in an employment transaction, to engage in a business transaction, or to engage in the contribution of money or other property. Solicitation shall be deemed complete when made whether or not an actual employment relationship is created, a business transaction is completed, or a contribution of money or other property takes place as a result of a solicitation. 4.75.020 Solicitations on highways prohibited.

A.    It is unlawful for any person, while that person is located on a highway, to solicit employment, business, or contributions from occupants of other vehicles on that highway.

B.    It is unlawful for any person, while occupying any vehicle on a highway, to solicit employment, business, or contributions from pedestrians or from occupants of vehicles on that highway. (Ord. 659, § 2; 1976 Code § 4-15.02).

4.75.030 Loitering on median strip prohibited.

It is unlawful for any person to loiter in a median strip within a highway. For the purposes of this section, “loiter” means to linger or remain in the median strip for any purpose unrelated to safely traversing a street or other roadway, except in an emergency. This section shall not apply to authorized city personnel or contractors who are repairing or maintaining the median strips or adjacent roadway. (Ord. 659, § 2; 1976 Code § 4-15.03).

4.75.040 Penalty – Enforcement.

The penalties for violations of any provisions of this chapter are set forth in Chapter 1.05 MMC. (Ord. 659, § 2; 1976 Code § 4-15.04).
