NEGLECT AND THE ABUSE OF ANIMALS

8.06.010 Definition.
Every person or entity having ownership or custody of an animal shall have an affirmative duty to adequately maintain and care for such animal. It shall be a violation of this code and a public nuisance per se to neglect, mistreat and/or fail to adequately maintain, care for, and/or provide sufficient nutrition to any animal resulting in a threat to the health and welfare of said animal. In the event that the City is required to take any action to abate the public nuisance or impound and/or rehabilitate the animal, the City shall be entitled to recover the actual costs related thereto, including reasonable attorney’s fees, as set forth in Section 1.04.010.
