GENERAL UTILITY PROVISIONS

5.1.002 Disconnection of Utilities.

a.    The Building Official or his/her designee is authorized to disconnect a utility service or energy supplied to a building, structure or building service equipment therein regulated by this Municipal Code or other adopted Uniform Codes where necessary to eliminate an immediate threat to life or property.

b.    Notice. The Building Official shall:

1)    Whenever possible, notify the serving utility, the owner and the occupant of the building, structure or building service equipment of the decision to disconnect prior to taking such action.

2)    Within three days of an action to disconnect, provide written notice regarding the disconnection. The notice must contain a statement of the facts upon which the Building Official has acted. The notice shall be mailed first-class U.S. mail, postage prepaid to a) the utility, b) the occupant of the building, structure or building service equipment and c) the property owner as shown on the last assessment roll. The notice shall also be conspicuously posted on the property.

c.    The Building Official shall rescind or modify such action when it becomes proper to do so in view of the danger or violation. Notice of such decision shall be provided pursuant to subsection (b) of this section.

d.    It is unlawful for any person, firm or corporation to make connection from energy, fuel or power supply or supply energy or fuel to building service equipment that the Building Official has disconnected, ordered disconnected, or ordered the use discontinued until the Building Official authorizes the reconnection and use.

e.    It is unlawful for any person, firm or corporation to make connections from a source of electrical energy or to supply electric service to any electric wiring, devices, appliances or equipment that the Building Official has disconnected, ordered disconnected, or ordered the use discontinued until the Building Official approves the reconnection and use.

f.    A violation of this chapter shall be a misdemeanor.
