3.12.010 Capital outlay fund—Establishment authority—Surplus funds disposition.

Pursuant to the provisions of Sections 53730 to 53737 inclusive of the Government Code of the state, the city council is authorized and directed to establish a capital outlay fund for the purposes in the sections set forth and to levy and collect assessments and taxes for the creation and accumulation of such fund. The city council is also authorized and empowered to transfer to such fund from time to time any unencumbered surplus funds remaining on hand at the end of any fiscal year or such portion or amount thereof as the council may deem advisable. (Ord. 189 § 1, 1964).

3.12.020 Gas tax street improvement fund—Created.

To comply with the provisions of Article 5 of Chapter 1 of Division 1 of the Streets and Highways Code, with particular reference to the amendments made thereto by Chapter 642, Statutes of 1935, there is created in the city treasury a special fund to be known as the “Special Gas Tax Street Improvement Fund.” (Ord. 75 § 1, 1935).

3.12.030 Gas tax street improvement fund—Payment into fund.

All moneys received by the city from the state under the provisions of the Streets and Highways Code for acquisition of real property or interests therein for, or the construction, maintenance or improvement of streets or highways other than state highways shall be paid into the fund. (Ord. 75 § 2, 1935).

3.12.040 Gas tax street improvement fund—Expenditure.

All moneys in the fund shall be expended exclusively for the purposes authorized by, and subject to all of the provisions of Article 5, Chapter 1, Division 1, of the Streets and Highways Code. (Ord. 75 § 3, 1935).
