FIRE HYDRANTS

9.04.010 Tampering with prohibited.

It is unlawful for any person to injure, damage, destroy or in any way tamper with any fire hydrant in the city. (Ord. 57 § 1, 1926).

9.04.020 Drawing water from prohibited—Exception.

No person shall draw any water from any such fire hydrant or cause any water to run therefrom, except under the immediate direction and instructions of the chief of police*, superintendent of streets or a member of the fire department of the city, acting in the official capacity of their respective offices. (Ord. 57 § 2, 1926).

*Editor’s Note: The term “marshal” has been editorially changed to “chief of police” in accordance with Section 1.08.020 of this code (Ord. 238).

9.04.030 Interpretation.

Nothing herein contained shall be construed as prohibiting inspections, repairs or replacements of any such fire hydrants from being made by the owner of the water system supplying and maintaining the hydrants, nor shall anything herein contained be construed as repealing any portion of any other ordinance relating to fire protection or the fire department of the city. (Ord. 57 § 3, 1926).

9.04.040 Penalty for violations.

Any person violating any provision of this chapter is guilty of a misdemeanor and on condition thereof shall be punished by a fine not exceeding one hundred dollars, or by imprisonment in the city jail, or the county jail not exceeding twenty-five days or by both such fine and imprisonment. No person who is financially unable to pay a fine shall be imprisoned for failure to pay such fine. Any judgment imposing a fine shall also provide that in default of payment of same, the defendant shall be imprisoned in such city or county jail at the. rate of one day for each twenty dollars of such fine remaining unpaid.
