9.34.010 Display of certain adult matter to minors—Blinder racks.

A.    Display of material which is harmful to minors, as defined in Chapter 7.6 of Title 9 of the California Penal Code, in a public place, other than a public place from which minors are excluded, is prohibited unless a device commonly known as a blinder rack is placed in front of such material so that the lower two-thirds of the material is not exposed to view.

B.    “Blinder rack” is defined as an opaque cover, blocking from view the lower two-thirds of the material, and the bottom edge of which is placed a minimum of at least five feet up from the floor in the place where such matter is sold, distributed or displayed whether with or without consideration.

C.    Every person who causes, permits, procures, counsels or assists in an offer of sale of any newspaper or similar publication in violation of the ordinance codified in this section is guilty of a misdemeanor.

D.    Any newspaper or similar publication offered for sale in violation of the ordinance codified in this section constitutes a public nuisance. (Ord. 463 § 1, 1991).
