ALCOHOLIC BEVERAGES

9.50.010 Prohibited in public place.

It is unlawful for any person to consume, drink, exhibit or possess an open container of any alcoholic or intoxicating beverage on any public place, including, but not limited to, any public street, sidewalk or alley and public parking lot in the city, except for:

A. Those properties under the jurisdiction of another public entity within the city, in compliance with that entity’s regulations; or

B. A special event, consistent with a permit approved by the city under PHMC Chapter 6.20, Special Event Permit, when alcoholic beverages are specifically approved. (Ord. 864 § 2, 2012; Ord. 575 § 1, 1985; 1991 code § 5-11.1)

9.50.020 Alcoholic beverages prohibited – Private juvenile parties.

It is unlawful for any person to suffer, permit, allow or host a party, gathering or event at his or her place of residence or other private property, place or premises under his or her control where five or more persons under the age of 21 are present and alcoholic beverages are in the possession of, or are being consumed by, anyone under the age of 21 years.
