6.64.010 Definitions.

For the purposes of this chapter, the following words have the following meanings:

“Public swimming pool” means an artificial basin, chamber, or tank, constructed or prefabricated with impervious bottoms and sides, as defined in Division 104, Part 10, Chapter 5, Article 5 of the California Health and Safety Code, relating to public swimming pools. This definition does not apply to any pool, permanent or portable, that is intended for noncommercial use as a pool by the occupants of not more than three dwelling units.

“Swimming pool service” means the treating of public swimming pool/spa waters, and the cleaning, servicing, maintaining, replacing or repairing (including equipment repair) of public pools/spas.

“Swimming pool service company” or “company” means any self-employed individual or any firm engaged in providing swimming pool service, as defined in this section, for a fee. [Ord. 38-2007 § 1 (Exh. 1(E)); Ord. 21-2003 §§ 2, 4; Ord. 20-2003 §§ 2, 4; SCC 1165 § 2, 2000; SCC 167 § 1 (part), 1974].

6.64.020 Scope.

This chapter shall apply to all public swimming pools, as defined in Division 104, Part 10, Chapter 5, Article 5 of the California Health and Safety Code and Titles 22 and 24 of the California Code of Regulations relating to public pools. 6.64.060 Maintenance standards.

All swimming pool service companies shall provide swimming pool services in accordance with the standards and requirements set forth in the provisions of Division 104, Part 10, Chapter 5, Article 5 of the California Health and Safety Code, and Titles 22 and 24 of the California Code of Regulations relating to public pools. 6.64.070 Repair and replacement of recirculation and purification equipment.

No swimming pool service company shall repair or replace pool recirculation or purification equipment without having in its possession an unexpired contractor’s license issued by the state of California. [Ord. 21-2003 §§ 2, 4; Ord. 20-2003 §§ 2, 4; SCC 1165 § 2, 2000; SCC 167 § 1 (part), 1974].

6.64.110 Penalties.

Any company or individual who violates any provision of this chapter is guilty of a misdemeanor punishable by a fine of not less than $500.00 nor more than $1,000. [Ord. 21-2003 §§ 2, 4; Ord. 20-2003 §§ 2, 4; SCC 1165 § 2, 2000; SCC 167 § 1 (part), 1974].

6.64.120 Repeated violations.
