Article 1. Police Reserves

5-2-100 Definitions.

Whenever in this Chapter the following terms are used, they shall have the meaning ascribed to them in this Section unless otherwise apparent from the context.

(A) “City Manager” shall mean the City Manager or his designee.

(B) “Reserve” shall mean the San Juan Bautista police reserve.

(C) “Member” shall mean a member of the San Juan Bautista police reserve.

5-2-105 Purpose.

(A) The purpose of this organization shall be to train and prepare the members of said reserve against the perils of life and property that may be expected to result from attack during war or from any disaster that may threaten lives and property in the City of San Juan Bautista.

(B) In the event of labor troubles or strikes, no member of this organization shall be called into service nor to duty which would in any way tend to involve him in the controversy.

(C) The services of this organization shall not be used in any manner that would circumvent the building up of the regular department to its proper strength, nor shall the services of individual members be used to the detriment of the personnel of the regular Police Department.

(D) The policy of this organization shall be nonpartisan and said organization, as such shall not partake in political activities of any kind.

5-2-110 Creation.

The City of San Juan Bautista police reserve is hereby created. Said reserve shall consist of the number of persons as the City Manager shall determine may be necessary.

5-2-115 Peace officers.

All persons appointed by the City Manager pursuant to the provisions of this Chapter shall be deemed to be peace officers while in the performance of duties assigned to them by the City Manager and shall be subject to the rules and regulations of the Police Department while on duty.

5-2-120 Qualifications.

The City Manager shall, by rule, prescribe the qualifications and standards by which applicants for membership in said reserve shall be governed and persons possessing said qualifications and conforming to said standards may be appointed to said reserve by the City Manager.

5-2-125 Training.

To be eligible for membership in the said reserve, each applicant must indicate his willingness to serve an average minimum of (8) hours per month in-service training and attend one (1) meeting per month. Should the member fail to attend the meeting said member shall be required to serve an additional eight (8) hours in-training-service, and where any member has failed to train said minimum hours for a period of two (2) months, the City Manager shall inquire into the reasons therefor and unless good reason is shown for said failure dismiss the member from said reserve.

5-2-130 Prescribed uniform, equipment.

The uniform, badge and equipment to be worn and carried by the member shall be prescribed by the City Manager.

5-2-135 Purchase of uniform, equipment.

Uniforms and other equipment will be purchased by the member at his own expense, except that the City of San Juan Bautista will furnish badges, hat shields, shoulder patches and identification cards to members. Upon the separation of any person from said reserve, all items issued to him by the City of San Juan Bautista shall be immediately returned to the City Manager and the member returning said items shall be entitled to no compensation therefor. Any items lost by the member must be replaced by him at his own expense.

5-2-140 Death, injury benefits.

In the event of death or injury to said member while he is discharging duties assigned him by the City Manager, said member or his beneficiaries shall be entitled to benefits provided by the Workman’s Compensation Laws of the State of California and such benefits shall be based upon the salary of first year patrolman in the Police Department.

5-2-145 Services determined by City Manager.

Members shall perform only such public services as may be ordered by the City Manager and it shall be unlawful for any person to wilfully resist, delay or obstruct any member in the discharge, or the attempt to discharge any duties of his office.

5-2-150 Impersonating officer.

It shall be unlawful for any person to falsely impersonate or represent himself to be a member or to wear, use or possess any badge or design intended to represent a law enforcement officer of the City of San Juan Bautista unless authorized to do so. All appointments of members of the City of San Juan Bautista auxiliary or special officers in the City of San Juan Bautista heretofore made, are cancelled with the effective date of this Chapter and any member of or person of holding any badge or card identifying such person as a member of any of said designated positions or organizations, is required to surrender said credentials to the City Manager of the City of San Juan Bautista.

5-2-155 Dismissal.

The City Manager may dismiss a member from said reserve without any hearing whatsoever, and each member shall have the right to resign from said reserve at any time.

5-2-160 Administrative officers.

The City Manager is hereby empowered and directed to appoint administrative officers from the officers of the Police Department and to prepare and promulgate such organizational order, rules, and regulations and revisions and amendments thereof, as may be, in his discretion necessary to carry out the express intent of this Chapter.

5-2-165 Violations, penalties.

All violations of this Chapter shall constitute a misdemeanor and a conviction for said violation shall be punishable by a fine of not to exceed one thousand dollars ($1,000) or by imprisonment in the County Jail for a period of one (1) year, or both said fine and imprisonment.
