Article 1. Duties Assigned

11-16-010 City Manager.

The City Manager shall hold administrative hearings or designate a hearing officer for such hearings as provided by this Chapter.

11-16-020 Historic Resources Board.

The Historic Resources Board shall hear and make recommendations to the Planning Commission on projects that are located within the historic overlay district or that involve an historic resource per Chapter 11-08 SJBMC.

11-16-060 Planning Commission.

The Planning Commission:

(A) May initiate General Plan amendments and specific plans or amendments.

(B) Hears and makes a recommendation to the City Council on all proposals for adoption and amendment of the General Plan.

(C) Hears and makes a recommendation to the City Council on all proposals for adoption and amendment of specific plans.

(D) May initiate zone changes and amendments to this Title.

(E) Hears and makes a recommendation to the City Council on proposals for zone changes, prezonings, and amendments to this Chapter, including those referred to it by the City Council.

(F) Hears and makes a recommendation to the City Council on proposals for planned unit developments.

(G) Hears and makes a recommendation to the City Council on proposals for subdivisions of five (5) lots or more.

(H) Determines whether to hear applications for rezoning made within one (1) year of a similar application.

(I) Determines variance applications.

(J) Determines conditional use permit applications.

(K) Determines design review applications.

(L) Determines time extension when it would have had the power to grant the original approval.

(M) Determines matters referred to it by the City Manager.

(N) Hears appeals from decisions of the City Manager or designee.

(O) Determines exceptions from the standards as provided by Chapter 11-14 SJBMC and determines when stricter standards than those generally imposed by this Title but specifically provided for in this Title apply.

(P) Performs any functions required by statute or ordinance but not specifically assigned by this Title.

(Q) Determines whether a nonconforming use is no longer lawful.

(R) Determines and issues approval for minor subdivisions of four (4) lots or less.

11-16-070 City Council.

The City Council:

(A) May initiate and refer General Plan amendments and specific plans or amendments to the Planning Commission for recommendation.

(B) Hears and determines Planning Commission recommendations for the adoption or amendment of the General Plan or any specific plans.

(C) Hears and determines Planning Commission recommendations for the approval of planned unit developments and subdivisions (five (5) or more lots).

(D) Adopts ordinances.

(E) May initiate and refer zone changes and amendments to this Title to the Planning Commission for recommendation.

(F) Hears appeals from the decisions of the Planning Commission.
