Article 1. Procedure

11-26-010 Amendments.

This Title may be amended by ordinance whenever the public necessity, convenience or general welfare requires. Any proposed amendment which changes property from one (1) zone to another or imposes any zoning regulation not previously imposed or which removes or modifies any such regulation therefor imposed, as set forth in Government Code Section 65850, must be adopted in accordance with the procedure set forth in Government Code Sections 65854 through 65857, as summarized in the following sections. Any other amendment to this Title may be adopted in the same manner as other ordinance amendments.

11-26-020 Amendment – Initiation.

An amendment may be initiated by direction of the City Council or Planning Commission, or by application of one (1) or more interested property owners, accompanied by a filing fee as specified in the “Cost for Service Fee Schedule.” An amendment initiated by application shall be signed by the owner(s) or authorized agent of property within the area that is the subject of the application, or by an authorized agent thereof attesting to the truth and correctness of the information contained therein.

11-26-030 Report of Planning Commission’s findings.

The Planning Commission shall consider the application and report its findings and recommendations to the City Council within ninety (90) days after the notice of the Planning Commission hearing; provided, that such time limits may be extended upon the mutual agreement of the parties having an interest in the proceedings.

11-26-040 Hearing – By City Council.

Upon receipt of the recommendation from the Planning Commission, the City Council shall hold a public hearing after notice thereof as provided by Government Code Section 65090.

11-26-050 Failure to receive notice.

The failure of any person or entity to receive notice given pursuant to this Chapter shall not constitute grounds to invalidate the actions of the Planning Commission or City Council.

11-26-060 Decision of City Council.

The decision of the City Council to approve, disapprove or modify the recommendation of the Planning Commission in whole or in part shall be rendered within sixty (60) days after the receipt of a report and recommendations from the Planning Commission.

11-26-070 Prezoning.

Property may be prezoned in connection with an annexation petition or application in the same manner as provided in this Chapter for zoning amendments.
