5.65.010 Definitions.

The words and terms used in this chapter shall have the following meanings unless the context clearly indicates otherwise:

(a) "Carnival" means any group of attractions, games, rides, such as ferris wheels, merry-go-rounds, or other riding devices, booths, concessions or exhibitions.

(b) "Circus" means an exhibition or entertainment at which feats such as horsemanship, acrobatic feats and trained or wild animals are exhibited or displayed, and which exhibition or entertainment is carried on by a person having no regular established place of business in the city for exhibition thereof.

(c) "Promotional show" means an exhibition, concession or attraction conducted on behalf of a business, commercial enterprise or group of businesses or commercial enterprises located in a shopping center area or other area close to or near the places where such commercial enterprises or businesses are conducted, for the purpose of attracting persons to such businesses or area, and at which ferris wheels, merry-go-rounds, whips or other ride devices or upon which concessions or other attractions are conducted. 5.65.020 Permit – Required – Application and information required.

No person shall operate any circus, carnival, sideshow, merry-go-round, amusement ride, ferris wheel or other similar devices without having first applied to and received a permit from the City Council to operate such business and without paying the business tax therefor. Any such application shall state in full the names of the owners of such business, the type of operation proposed to be conducted and the location and site where such is proposed to be operated or conducted. 5.65.030 Investigation – Denial.

The City Council may make or cause to be made an investigation of the proposed location or site where such businesses enumerated in SCCC 5.65.020 will be conducted and of the person proposing to operate such business and of the type or kind of operation proposed. If the City Council shall determine that the type or operation of such business shall cause any annoyance or disturbance to persons residing in or conducting businesses in the vicinity or neighborhood of such site or location, that such site or location is an improper site or location therefor, that the proposed operation of such business will not be for the best interests of the neighborhood of such location the Council may deny the permit required in SCCC 5.60.020. 5.65.040 Personal liability insurance requirements.

Before a permit is issued to operate or conduct any business enumerated under this chapter the operator shall furnish the City Clerk with a certificate of insurance issued by a responsible insurance company which verifies that such operator has purchased a comprehensive general liability insurance policy which includes limits not less than one million dollars ($1,000,000.00) per occurrence covering any person injured by the operation of such business against loss or damage arising from any personal injury or property damage. Operator shall maintain such insurance covered for the duration of the term of the permit. (Ord. 1724 § 2, 10-27-98. Formerly § 22-15.4).

5.65.050 Business tax certificate required.

After permit approval, every person engaged in the business of operating a carnival, circus, promotional show or similar business enterprise shall apply for and pay the business tax as required in SCCC 3.40.330. (Ord. 1724 § 2, 10-27-98. Formerly § 22-15.5).
