REGULATION OF THE DISTRIBUTION
OF CERTAIN ADVERTISING MATERIAL INCLUDING HANDBILLS

9.15.010 Purpose and intent.

The purpose of this chapter is to protect against criminal activity, minimize the unwelcome disturbance of citizens and the disruption of privacy and to otherwise prevent litter and the accumulation of uncollected written materials. (Ord. 1722 § 5, 10-27-98. Formerly § 18-33.1).

9.15.020 Definitions.

The words and terms used in this chapter shall have the following meanings unless the context clearly indicates otherwise:

(a) "Distribute" means deliver, dispense, apportion or scatter something.

(b) "Handbill" means any commercial advertising, booklet, card, circular, dodger, newspaper, pamphlet, sample specimen, sheet or other printed or written notices, advertising any art, article, business, commodity, entertainment, meeting, merchandise, person, service, skill or thing offered, sold, or rendered for hire, reward, price, trade or profit.

(c) "Handbill restriction register" means a list of those addresses in the City that request no handbills be distributed or left on the premises. (Ord. 1722 § 5, 10-27-98. Formerly § 18-33.2).

9.15.030 Handbill distribution prohibited.

No person shall distribute any handbill to or upon any premises in the City:

(a) When such premises has posted thereupon a legible sign with letters at least one inch high in a conspicuous place near the entrance and visible from the street stating "no handbill distribution" or words to that effect; or

(b) When the owner or occupant of such premises has filed with the Director of Finance of the City a written notice objecting to the time of delivery of handbills to such premises.

It is the intent of this provision that for a person to be in violation of this section he must have had knowledge of the prohibition before or at the delivery of handbills to such premises. (Ord. 1722 § 5, 10-27-98. Formerly § 18-33.3).

9.15.040 Public register of objections.

The Director of Finance shall keep a register open to public inspection showing the premises covered by objections filed in accordance with the provisions of SCCC 9.15.030(b). (Ord. 1722 § 5, 10-27-98. Formerly § 18-33.4).

9.15.050 Business tax certificate required.

A handbill distributor shall apply for and obtain a business tax certificate with the municipal services/business tax division as required in SCCC 3.40.500. Each applicant shall provide a statement that the handbill restriction register has been reviewed and information therein noted and agrees not to distribute handbills to any premises listed in the register. A copy of the handbill restriction register may be obtained upon request and payment of such charge as established by resolution of the City Council. (Ord. 1722 § 5, 10-27-98. Formerly § 18-33.5).
