12.10.010 Unlawful to erect or paint advertisements on sidewalks.

No person shall erect or maintain any sign or advertising device on any public street or sidewalk of the City, or paint or mark any sign, advertising or other marking upon the pavement, curb or sidewalk constituting part of a public street; provided, however, nothing herein contained shall prohibit any person from painting or applying the street address number on the curb in front of a premises owned or controlled by him or the painting or application of numbers on curbs by persons possessing a valid business tax certificate granted for the purpose of curb painting. 12.10.020 Consent by person in control of property.

No person shall paint or otherwise apply any number on the curb of any premises not owned or controlled by him without the prior consent of the owner or a person in lawful control of said premises. No request shall be made that any payment for services rendered hereunder be made prior to completion of the work. (Ord. 1725 § 2, 10-27-98. Formerly § 25-9.2).

12.10.030 Approval of Director of Public Works or City Engineer.

No person shall paint or otherwise apply any number on the curb without the Director of Public Works or City Engineer having approved the size and form of the numbering proposed to be painted or applied and the suitability of the color and quality of the paint or material to be used. 12.10.040 Business tax certificate required.

No person shall conduct the type of business referred to in this chapter until the requirements of Chapter 5.05 SCCC have been completed and approval granted and the business tax stated in SCCC 3.40.330 has been paid. (Ord. 1725 § 2, 10-27-98. Formerly § 25-9.4).

12.10.050 Revocation – Appeal.

The solicitor permit issued for painting or applying numbers on curbs may be canceled:

(a) For any reason which would have justified denial of such;

(b) For painting or permitting the painting of any curb without prior consent of the owner or person in lawful possession of the premises abutting the street at the location of said curb;

(c) For failure to observe the specifications approved by the Director of Public Works or City Engineer; or

(d) For any violation of any State law or City ordinance or regulation by the holder of a solicitor permit in connection with curb painting activities.

Appeal from denial of a certificate may be made to the City Council in the manner provided in Chapter 2.115 SCCC. (Ord. 1725 § 2, 10-27-98; Ord. 1770 § 3, 8-20-02. Formerly § 25-9.5).

12.10.060 Specific penalty.

Although any person who shall violate any of the provisions of this chapter shall be guilty of a misdemeanor as provided in SCCC 1.05.070, a specific penalty in a form of a fine of fifty dollars ($50.00) is hereby provided for each violation of the provision in SCCC 12.10.010 that no person shall paint or otherwise apply any number on the curb in front of any premises not owned or controlled by him without the prior consent of the owner or a person in lawful control of said premises.
