18.34.010 Application.

The regulations set forth in this chapter apply in all CN zoning districts. (Zoning Ord. § 17-1).

18.34.020 Intent.

This is a limited commercial zone that provides retail goods and services for the convenience of the immediately adjacent residential neighborhood. (Zoning Ord. § 17-2).

18.34.030 Permitted uses.

All uses shall be conducted wholly within a completely enclosed building, except as provided in this section or in SCCC 18.34.040. Only the following uses, or uses that, in the opinion of the Planning Commission, are of a similar nature, will be permitted:

(a) Retail sales or rentals of new merchandise or service:

(1) Clothing stores.

(2) Pharmacies.

(3) Grocery stores or delicatessens.

(4) Hardware stores.

(5) Stores which sell alcoholic beverages (packaged goods off-sale).

(6) Restaurants, excluding those which sell or serve alcoholic beverages. Outdoor use of designated seating areas for twelve (12) or fewer customers of such restaurants, within an area of two hundred fifty (250) square feet or less, is allowed if Director of Community Development approval is obtained and such outdoor use is operated in conformance with any conditions of approval.

(7) Bookstores and video stores, provided more than fifty percent (50%) of the displayed inventory or stock on hand, at any one time, is not adult oriented as defined and regulated in Chapter 18.70 SCCC.

(b) Sales of personal or financial services:

(1) Barber shops and beauty parlors.

(2) Banks and savings and loans.

(3) Clothes cleaning, laundry pickup stations, launderettes, and pressing shops.

(4) Professional offices, such as accountants, architects, or doctors.

(5) Nurseries and preschools.

(6) Studios and instructional facilities, such as dance studios, music studios, or similar establishments, in which a specific subject is taught, as distinguished from a public or private general educational school. This category does not include facilities in which industrial training is provided, such as welding or automotive repair, involving the use of tools and materials appropriate to an industrial use area.

(7) Massage establishments, as defined in SCCC 5.40.020(m), subject to SCCC 18.104.020.

(c) Incidental and accessory buildings and uses on the same lot with, and necessary for, the operation of any permitted use. Such uses may include a parking lot, if constructed at, or within thirty-six (36) inches of, the elevation of the top of the nearest street curb. 18.34.040 Conditional uses.

The following conditional uses may be established only by first securing a use permit in each case as provided in Chapter 18.110 SCCC:

(a) Automobile service station (subject to the provisions set forth in Chapter 18.68 SCCC).

(b) Stores which sell beer and/or wine (packaged goods off-sale) located on the same parcel as an automobile service station (subject to the provisions set forth in Chapter 18.68 SCCC).

(c) Neighborhood bar and/or restaurant which serves or sells alcoholic beverages, with an area of less than one thousand five hundred (1,500) square feet (including any outdoor seating). Dancing or live entertainment shall not be permitted.

(d) Outdoor walk-up service facility.

(e) Animal clinic or animal hospital (not kennels).

(f) Parking lot and/or parking structures constructed at an elevation more than thirty-six (36) inches above or below the elevation of the top of the nearest street curb. (Zoning Ord. § 17-4).

18.34.050 Lot area.

Each lot or commercial complex shall contain a minimum area of ten thousand (10,000) square feet and shall not exceed a maximum area of eighty thousand (80,000) square feet including the area devoted to service station use. (Zoning Ord. § 17-5).

18.34.060 Lot width.

The minimum lot width shall not be less than eighty (80) feet. (Zoning Ord. § 17-6).

18.34.070 Building height limits.

Maximum permitted height shall not exceed thirty-five (35) feet. (Zoning Ord. § 17-7).

18.34.080 Front yard.

Each lot shall have a street side front yard of not less than fifteen (15) feet in depth. (Zoning Ord. § 17-8).

18.34.090 Side yards.

Side yards are required at each side of every lot that is adjacent at that side of the lot to a residentially zoned property or property designated as residential in the general plan. Each such side yard shall not be less than ten feet in width.

The street side yard of each corner lot exclusive of front yard shall not be less than fifteen (15) feet in width. (Zoning Ord. § 17-9).

18.34.100 Rear yard.

A rear yard is required at the rear of each lot that is adjacent at the rear of the lot to a residentially zoned property or property designated as residential in the general plan. Such rear yard shall not be less than twenty (20) feet in depth. (Zoning Ord. § 17-10).

18.34.110 Maximum building coverage.

No requirement; subject to required parking, landscaping, and setbacks. (Zoning Ord. § 17-11).

18.34.120 Open landscaped area.

The following yards and areas shall be developed into and permanently maintained as open landscaped areas containing ground cover, trees, and shrubs:

(a) Required front yards; and

(b) Street side yards of corner lots (with openings for accessways in accordance with City standards); and

(c) A minimum landscaped area equal to at least ten percent of the required parking area, to be evenly distributed throughout the parking area and adjacent to buildings. (Zoning Ord. § 17-12).

18.34.130 Minimum parking requirements.

The minimum parking requirements are as specified in Chapter 18.74 SCCC. (Zoning Ord. § 17-13).

18.34.140 Additional development standards.

(a) Fencing. At the time of new construction or reconstruction of a building on property, a solid fence of masonry six feet high shall be installed and thereafter maintained by the owner of property in this zoning district on all common property lines with residentially zoned property or with property designated as residential in the general plan.

Fencing shall not exceed three feet in height in required front or street side yard areas.

(b) Landscaped Buffer. A planter landscaped in screening shrubs and trees is required and shall be permanently maintained adjacent to the fencing and property lines abutting a residentially zoned property or property designated as residential in the general plan. Each planter area shall be surrounded with a six-inch raised concrete curbing or planning division-approved equivalent. Minimum width of planter shall be five feet. An irrigation system shall be installed and permanently maintained in working order in each separate planter area.

(c) Lighting. Lighting, if provided, shall reflect away from residential areas and public streets.

(d) Trash Disposal. Each property shall provide adequate and accessible trash disposal areas. Said disposal area shall be screened from public view by a masonry enclosure, with solid wood gates, at least six feet in height. (Zoning Ord. § 17-14).
