18.36.010 Application.

The regulations set forth in this chapter apply to all CC zoning districts. (Zoning Ord. § 18-1).

18.36.020 Intent.

This is a general shopping center zone district, which is intended to encourage organized concentration of a wide variety of retail goods and services for the community. (Zoning Ord. § 18-2).

18.36.030 Permitted uses.

None but the following uses or uses that, in the opinion of the Planning Commission, are of a similar nature will be permitted.

All uses shall be conducted wholly within a completely enclosed building, except as provided in SCCC 18.36.040.

(a) Any use permitted in the CN or OG district subject to the regulations set forth in this chapter.

(b) The following retail business establishments, shops, and offices supplying commodities or performing services for residents of the surrounding community:

(1) Animal hospital – clinic or veterinarian (no kennel).

(2) Antique shop.

(3) Appliance sales and service.

(4) Art goods.

(5) Auto accessory sales facility not involving installation on the premises.

(6) Bakery.

(7) Beauty college.

(8) Bicycle sales and repair.

(9) Book store including rental.

(10) Candle shop.

(11) Carpets, rugs, draperies.

(12) Confectionery.

(13) Department store.

(14) Florist.

(15) Furniture store.

(16) Hobby shop.

(17) Import store.

(18) Jewelry sales and repair.

(19) Pet shop.

(20) Pipe and tobacco shop.

(21) Radio and television sales and service.

(22) Repair shop for domestic appliances, radios, shoes.

(23) Secondhand sales.

(24) Shoe store.

(25) Sporting goods.

(26) Stationery store.

(27) Tailoring and custom dressmaking.

(28) Massage establishments, as defined in SCCC 5.40.020(m), subject to SCCC 18.104.020.

(c) Incidental storage and accessory uses, including repair operations and services, provided such uses shall be clearly incidental to the sale of products at retail on the premises and shall be so located, constructed and operated as not to be offensive or objectionable because of dust, gas, smoke, noise, fumes, odors, vibrations, or other public nuisances. 18.36.040 Conditional uses.

The following conditional uses may be established only by first securing a use permit in each case as provided in Chapter 18.110 SCCC.

(a) Any conditional use permitted in the CN or OG district, subject to the regulations set forth in this chapter.

(b) Amusement or recreational enterprise, such as arcade, bowling alley, or pool hall.

(c) Drive-through service facility.

(d) Outdoor walk-up service facility, if located within one hundred (100) feet of a residentially zoned property or property designated as residential in the general plan.

(e) Outdoor activity, display, or storage ancillary to a permitted use, such as incidental nursery display or tire, battery, or auto accessory service center.

(f) Theater (indoor).

(g) Smoking lounges, pursuant to Chapter 8.37 SCCC. (Zoning Ord. § 18-4; Ord. 1939 § 3, 3-24-15).

18.36.050 Lot area.

Each lot shall contain a minimum area of fifteen thousand (15,000) square feet. (Zoning Ord. § 18-5).

18.36.060 Lot width.

The minimum lot width shall not be less than one hundred fifty (150) feet. (Zoning Ord. § 18-6).

18.36.070 Building height limits.

Maximum permitted height shall not exceed fifty (50) feet. (Zoning Ord. § 18-7).

18.36.080 Front yard.

Each lot shall have a street side front yard of not less than twenty-five (25) feet in depth. (Zoning Ord. § 18-8).

18.36.090 Side yards.

(a) Interior Lot. Side yards are required at each side of every lot that is adjacent at that side of the lot to a residentially zoned property or property designated as residential in the general plan. Each such side yard shall not be less than ten feet in width.

(b) Corner Lot. The street side yard of each corner lot exclusive of front yard shall not be less than twenty-five (25) feet in width. (Zoning Ord. § 18-9).

18.36.100 Rear yard.

A rear yard is required at the rear of each lot that is adjacent at the rear of the lot to a residentially zoned property or property designated as residential in the general plan. Such rear yard shall not be less than twenty (20) feet in depth. (Zoning Ord. § 18-10).

18.36.110 Maximum building coverage.

No requirement; subject to required parking, landscaping, and setbacks. (Zoning Ord. § 18-11).

18.36.120 Open landscaped area.

The following yards and areas shall be developed into and permanently maintained as open landscaped areas containing ground cover, trees, and shrubs:

(a) Required front yards; and

(b) Street side yards of corner lots (with openings for accessways in accordance with City standards); and

(c) A minimum landscaped area equal to at least ten percent of the required parking area, to be evenly distributed throughout the parking area and adjacent to buildings. (Zoning Ord. § 18-12).

18.36.130 Minimum parking requirements.

The minimum parking requirements are as specified in Chapter 18.74 SCCC. (Zoning Ord. § 18-13).

18.36.140 Additional development standards.

(a) Fencing. At the time of new construction or reconstruction of a building on property, a solid fence of masonry six feet high shall be installed and thereafter maintained by the owner of property in this zoning district on all common property lines with residentially zoned property or with property designated as residential in the general plan. Fencing shall not exceed three feet in height in required front or street side yard areas.

(b) Landscaped Buffer. A planter landscaped in screening shrubs and trees is required and shall be permanently maintained adjacent to the fencing and property lines abutting a residentially zoned property or property designated as residential in the general plan. Each planter area shall be surrounded with a six-inch raised concrete curbing or planning division-approved equivalent. Minimum width of planter shall be five feet. An irrigation system shall be installed and permanently maintained in working order in each separate planter area.

(c) Lighting. Lighting, if provided, shall reflect away from residential areas and public streets.

(d) Trash Disposal. Each property shall provide adequate and accessible trash disposal areas. Said disposal area shall be screened from public view by a masonry enclosure, with solid wood gates, at least six feet in height. (Zoning Ord. § 18-14).
