STORMWATER MANAGEMENT UTILITY

16.18.010 UTILITY CREATED.

A surface water, stormwater and flood control management utility is hereby created as a city enterprise and utility to operate, maintain, and fund the city’s surface water, stormwater and flood control management systems. The purpose of this utility is to provide for, among other related matters, the funding, permitting, maintaining, planning, designing, retrofitting, reconstructing, constructing, environmentally restoring, regulating, surveying, water quality testing, and inspecting of surface water, stormwater and flood control facilities, and the management thereof.

16.18.020 MANAGEMENT OF UTILITY.

The city council may adopt surface water, stormwater and flood control management programs or regulations to facilitate operation of the utility. The director of public works shall act as director of the utility and shall be responsible for administering and supervising the operations of the surface water, stormwater and flood control management systems in accordance with the provisions of the management programs adopted by the city council, and revised from time to time, pursuant to city council resolution.

16.18.030 FEES.

The city council may establish a surface water, stormwater and flood control management utility fee to be imposed upon users of the surface water, stormwater and flood control management systems, with the basis and amount of the fee to be established by resolution. The purpose of the fee is to provide funds:

(1)    To improve water quality of surface water and stormwater runoff;

(2)    To maintain and operate surface water, stormwater and flood control management facilities;

(3)    To pay for the costs of planning, permitting, designing, establishing, acquiring, developing, upgrading, retrofitting, constructing, reconstructing or improving surface water, stormwater and flood control management facilities and public improvements, and the management thereof; and

(4)    To pay for, or secure the payment of, any indebtedness incurred for such purposes.

16.18.040 COLLECTION.

Any fee imposed pursuant to this chapter shall be collected by the finance director in accordance with provisions set forth in the resolution establishing the basis and amount of the fee. The fees may be collected directly from users, or the city may contract for the collection by other public agencies.
