8.28.010 Firearm defined.

“Firearm” means guns, pistols, shotguns, revolvers or any other firearms of a similar nature. [Ord. 1201, 1966; Ord. 462, 1955; prior code § 8.25.010].

8.28.020 Gallery or range permits required.

(A)    The Board of Supervisors may, upon application and after public hearing as set forth in this section, grant a conditional permit or permits to operate and conduct a private, noncommercial shooting gallery, trap shooting, rifle or target range, and the person or persons having such permit shall not be subject to the provisions of this chapter. Notice of the public hearing shall be given in accordance with the provisions of SCCC 18.10.223.

(B)    An application for such a permit shall be filed stating the particular place where the permitted activity is to be conducted, together with an application fee established by resolution, and a petition in support of the application signed by not less than 25 residents who reside within a one-quarter mile radius of the subject property or signed by at least 50 percent of the residents who reside within a one-quarter mile radius of the subject property. Any such permit shall not be transferable and shall be revocable upon good cause appearing therefor to the Board.

(C)    An application shall only be approved if the Board finds that the proposed location of the shooting gallery, trap shooting, rifle or target range and the conditions under which it would be operated or maintained will not be detrimental to the health, safety or welfare of persons residing or working in the neighborhood or the general public, and will not be materially injurious to properties or improvements in the vicinity.

(D)    If the shooting gallery, trap shooting, rifle or target range is to be open to the public or members of a group, club or other organization, or if payment of any kind is to be received from users thereof, the application shall also be subject to County land use regulations, including all application and findings provisions, and shall be processed as a Level VII application. 8.28.030 Discharge prohibited in certain areas.

It is unlawful for any person to discharge firearms of whatsoever kind or character within the following described areas of the County:

(A)    Situated in the County and more particularly bounded and described as follows:

Beginning at a point on the centerline of Hecker Pass Road (State Highway 32-A) on the northwesterly projection of the southeastern boundary of lands conveyed to S. H. Gandrup by deed recorded in Volume 1328, Official Records at Page 169, Santa Cruz County Records; thence southeasterly, along said projection and boundary southerly, southwesterly and southeasterly along the southwestern, western, northwestern, and southwestern boundaries of said lands of Gandrup and the southeasterly projection of said southwestern boundary to the southeastern boundary of land conveyed to S. B. Beginning at a point on Empire Grade at Station 115+40, “P” Station 15+65, which point is 0.30 mile northwesterly from the intersection of Smith Grade Road with Empire Grade; thence northerly 0.75 mile along Empire Grade as originally traveled prior to the 1961 realignment to “P” Station 55+02.7 and Station 175+00 of the realignment. (I)    Being those portions of Section 33, Township 9 South, Range 2 West and Section 4, Township 10 South, Range 2 West described as follows:

Beginning at the northwest corner of Parcel A as recorded in Volume 34 of parcel maps at Page 49, Santa Cruz County Records, thence from said point of beginning along the northerly boundary of said Parcel A and the prolongation thereof to the westerly side line of Ridge Road as shown in Volume 19 of Maps at Page 20 and 21, Santa Cruz County Records; thence southerly along said road 3100 feet a little more or less to the southerly line of South Lane; thence leaving said Ridge Road southerly 1450 feet a little more or less to the centerline of Smith Creek; thence southeasterly along said creek centerline to the northwest corner of the lands of Carl A. Being a part of Sections 20, 28 and 29 T.10 S., R. 2 W., M.D.B & M. and more particularly described as follows:

Beginning at the northwest corner of the Rancho De La Canada del Rincon, said point is marked in two places with an old mark “C.R.J.”; thence running along the northerly boundary of said Rancho De La Canada del Rincon north 82° 13' east 1793.55 feet to the northwest corner of Parcel 6 of the lands conveyed to the Felton Water Company by deed recorded June 16, 1953, in Volume 918, Page 188, Official Records of Santa Cruz County; thence leaving the said Rancho boundary and running along the westerly and southerly boundary of said lands of Felton Water Company the following courses and distances. 8.28.040 Exceptions.

The provisions of this chapter shall not apply to the following exceptions:

(A)    Employees of Federal, State and local governmental agencies when the discharge of firearms is necessary in performance of their official duties for the protection and/or welfare of the public;

(B)    Private landowners, on their own property, when the discharge of firearms is necessary to eliminate pests or crop-destroying animals on their property;

(C)    Existing shooting galleries, trap shooting, rifle or target ranges operating within said restricted territory pursuant to a valid use permit on the effective date of the addition of the territory as a part of this chapter; and

(D)    Persons legally discharging firearms for the purpose of dog training with a 10-gauge or smaller shotgun and using no larger than size two shot; provided, however, that all discharge of firearms is prohibited within 150 yards of the Pajaro River Levee from a point 1,250 yards (approximately 0.7 miles) downstream of Thurwachter Bridge south to the Pacific Ocean. Such persons must hold a valid State dog training permit, have written permission from the landowner and operate only during those months permitted by the State. 8.28.050 Discharge near buildings.

Notwithstanding any of the other provisions of this chapter allowing the discharge of any firearms, it is unlawful for any private person other than the owner, person in possession of the premises, or a person having the express permission of the owner or person in possession of the premises to discharge any firearms, including shotguns, anywhere in the unincorporated area of the County within 150 yards of any occupied dwelling house, residence, or other building or barn or other outbuilding used in connection therewith. 8.28.060 Violation—Penalty.

8.28.070 Discharging onto property of another without permission.

It shall be unlawful for any person to discharge any firearm in such a manner as to cause a projectile from that firearm to land on the property of another without the permission of the property owner. [Ord. 4004 § 1, 1989].
