9.43.010 Motor Vehicle Code definitions to be used.

Whenever any words or phrases used herein are not specifically defined in this chapter, but are defined in the Vehicle Code of the State of California and amendments thereto, the definitions contained in the Vehicle Code shall apply. [Ord. 4155 § 1, 1991].

9.43.020 Establishment of parking regulations.

Under the authority of Vehicle Code Sections 22507 through 22519, inclusive, the Board of Supervisors hereby establishes parking regulations in Soquel Village including, but not limited to, time limits, prohibited uses on public parking lots and parking for handicapped persons. For purposes of this chapter, “Soquel Village” shall mean the area within the boundaries established by the Board of Supervisors for County Service Area 9F, Soquel Village Parking District. 9.43.030 Establishment of public off-street parking lots.

Off-street parking lots, as hereinafter designated, are defined and established as time-limited parking lots and shall be governed by the provisions of this chapter. Such parking lots shall be designated by number and shall be located as shown upon a map or maps designated as “Off-Street Parking Lot Map, Soquel Village,” which map or maps are on file with the Clerk of the Board. Said map(s) and all amendments thereto and markings thereon are incorporated in this chapter by reference and made a part of this chapter, as though fully set forth in full. 9.43.035 Establishment of time-limited public on-street parking areas.

On-street parking areas, as hereinafter designated, are also defined and established as time-limited parking and shall be governed by the provisions of this chapter. Such parking areas shall be designated as Soquel Drive between Daubenbiss Avenue and the Soquel Creek bridge and Walnut Street between Porter Street and Daubenbiss Avenue. 9.43.040 Hours during which time limits are effective.

Except where otherwise specified, the provisions of this chapter relating to parking time limits for parking lots and on-street parking areas shall be effective between the hours of 8:00 a.m. and 8:00 p.m. every day except holidays. Parking time limits for Walnut Street shall be effective between the hours of 8:00 a.m. and 5:00 p.m. [Ord. 4380 § 2, 1995; Ord. 4155 § 1, 1991].

9.43.045 Overnight parking prohibited.

No parking shall be allowed in public parking lots between 2:00 a.m. and 5:00 a.m. any day including holidays with the exception of vehicles displaying an “overnight permit” pursuant to SCCC 9.43.135. [Ord. 5035 § 1, 2009; Ord. 4380 § 2, 1995; Ord. 4155 § 1, 1991].

9.43.050 Unlawful to park longer than time limit.

No operator of any vehicle shall permit the vehicle to be parked in any public parking space for a period longer than the established parking time limit for said parking lot or on-street parking area. Time limits for public parking lots and on-street parking areas in Soquel Village shall be established by resolution by the Board of Supervisors. [Ord. 4380 § 2, 1995; Ord. 4155 § 1, 1991].

9.43.055 Unlawful to park commercial or large vehicles.

No operator of any vehicle shall park upon any public parking lot any commercial vehicle as defined in Section 260 of the California Vehicle Code or any vehicle weighing in excess of three tons. [Ord. 4155 § 1, 1991].

9.43.060 Leaving vehicle parked after receipt of overtime parking citation.

No operator of any motor vehicle shall permit the vehicle to remain parked in the same public parking lot or on-street parking area after receipt of a violation citation for exceeding the parking time limit. Violation of this section will incur only after passage of the succeeding parking time limit of the lot or on-street parking area as recorded by the preceding violation citation. 9.43.070 Unlawful to extend time limit by moving vehicle.

No operator of any vehicle shall permit the vehicle to be moved from one parking space to another within any public parking lot or on-street parking area, at any time and in such manner that the vehicle remains in the parking lot or on-street parking area a period of time in excess of the parking time limit for the parking lot or on-street parking area. 9.43.080 Unlawful to extend time limit by moving vehicle from lot.

No operator of any motor vehicle shall permit the vehicle to be removed from any public parking lot or on-street parking area, and immediately returned to said lot or on-street parking area thereafter, for the purpose of avoiding the time limitation of said parking lot established by SCCC 9.43.050 or for the purpose of evading the prohibition against extending the time in the manner provided in SCCC 9.43.070. 9.43.090 Unlawful to remove tire markings.

No operator of any motor vehicle shall remove or permit the removal of any tire marking or other marking or device affixed to the motor vehicle in connection with the enforcement of established time limits, so as to avoid or impair the enforcement of provisions of this chapter. 9.43.100 Unlawful to park outside of marked space.

(A)    The Director of the Public Works Department for the County of Santa Cruz is authorized to install and maintain parking space markings to indicate parking spaces in public parking lots or on-street parking areas or where authorized parking is permitted. When such parking space markings are placed on the surface of the lot or on-street parking area, subject to other or more restrictive limitations, no vehicle shall be stopped, left standing or parked other than within a single space unless the size or shape of such vehicle makes compliance impossible.

(B)    No person who owns or has possession, custody or control of any vehicle shall park or permit to be parked such vehicle in spaces marked as a crosswalk or in front of a public driveway except that a bus may stop to load or unload passengers as authorized by local ordinance.

(C)    No vehicle shall park in any designated fire lane identified by sign and red curb markings or marked with the words “Fire Lane” in red paint. [Ord. 4380 § 4, 1995; Ord. 4155 § 1, 1991].

9.43.105 Parking meter zones.

(A)    Pursuant to California Vehicle Code Section 22508, Soquel Village is established as a parking meter zone.

(B)    Fees for parking within the Soquel Village parking meter zone shall no more than $0.75 per hour, except that, beginning on January 1, 2018, and reoccurring annually thereafter, the parking meter fees provided in this section, or any successor section, shall increase by 10 percent rounded down to the nearest $0.05, unless the Director of Public Works elects in writing to not increase the parking meter fees for a given year. Within these limits, the current fee shall be established annually by resolution of the Board and shall be effective only upon posting of notice thereof within the Soquel Village parking meter zone.

(C)    A special capital improvement fund to be known as the capital facilities fund is created by this section. During each budget deliberation process, the Board of Supervisors will approve the amount of revenue derived from parking within the Soquel Village parking meter zone to be directed to said fund. Such fund may be used for purposes of the acquisition, development, and improvement of public parking facilities, road repair or maintenance, as well as other capital expenditures necessary to improve other related infrastructure located within the Soquel Village parking meter zone.

(D)    A special fund to be known as the neighborhood and business enhancement fund is created by this section. During each budget deliberation process, the Board of Supervisors will approve the amount of revenue derived from parking within the Soquel Village parking meter zone to be directed to said fund. Such reserve shall be used for purposes of enhancing and supplementing services to the neighborhood in the Soquel Village parking meter zone and not supplanting existing services. Enhancements may be in the form of capital improvements such as sidewalk repair, special services or extraordinary maintenance and shall include all expenditures necessary or convenient to accomplish such purposes.

(E)    No person shall park a vehicle in the Soquel Village parking meter zone, except as otherwise permitted by this section, without immediately depositing in the parking meter corresponding to the parking space occupied such lawful payment as is permitted or required by such parking meter, and when required by directions on the meter setting in operation the timing mechanism thereof, unless the parking meter indicates at the time such vehicle is parked that an unexpired portion remains of the period of time for which a payment has previously been deposited.

(F)    Directions shall be placed on each parking meter indicating the coin slot and how the meter is activated, and on each parking meter or on signs visibly displayed in the vicinity of the meter showing the coins that may be deposited, the time the meter will measure after such deposit, and the hours of the day deposits are required.

(G)    No person shall park any vehicle in any parking space within the Soquel Village parking meter zone where the parking meter is inoperative and which is signposted, as provided in this section.

(H)    No person, except as otherwise provided in this chapter, shall cause, permit, allow or suffer any vehicle registered to or parked or operated by him to be or remain parked in any parking space in the Soquel Village parking meter zone during any time when the parking meter corresponding to such parking space indicates that no portion remains of the period of time for which payment has been deposited or beyond the time parking in such place is otherwise permitted or limited.

(I)    No person shall deposit in any parking meter any slug, device or other substitute for lawful coin of the United States.

(J)    No person, except an agent or employee of the County in the course of his or her employment, shall deface, injure, tamper with, open, or willfully break, destroy or impair the usefulness of any parking meter.

(K)    Meters shall be in operation from 8:00 a.m. until 8:00 p.m., every day, except County holidays, unless otherwise ordered by resolution of the Board, effective only upon posting of notice thereof within the Soquel Village parking meter zone. A vehicle may be parked and remain parked in a parking space in any parking meter zone open to parking without the deposit of any coin in the parking meter adjacent thereto during any other time unless otherwise prohibited by this chapter or by resolution of the Board.

(L)    Seasonal Suspension of Meter Operation. When the Board of Supervisors determines that the year-round operation of some or all of the parking meters in the parking meter zones established pursuant to this chapter is not necessary for the regulation of traffic and parking, it may by resolution designate such meters and suspend the operation thereof for periods of time specified in such resolution, effective only upon posting of notice thereof within the Soquel Village parking meter zone.

(M)    Parking Meter Permit. In the Soquel Village parking meter zone established by this section, a vehicle may be parked and remain parked in a parking space without the deposit of any payment in the parking meter corresponding thereto if such vehicle has displayed a current valid parking permit issued by the County pursuant to the authorization of the Board of Supervisors. 9.43.110 Parking for demonstration prohibited.

No person who owns or has possession, custody or control of any vehicle shall park or permit to be parked such vehicle upon any public parking lot or on-street parking area for the principal purpose of advertising or displaying it for sale. [Ord. 4380 § 4, 1995; Ord. 4155 § 1, 1991].

9.43.120 Repairing or greasing vehicles prohibited.

No person who owns or has possession, custody or control of any vehicle shall construct or cause to be constructed, repair or cause to be repaired, grease or cause to be greased, dismantle or cause to be dismantled, any vehicle or any part thereof upon any public parking lot or on-street parking area. Temporary emergency repairs may be made upon a public parking lot or on-street parking area. [Ord. 4380 § 4, 1995; Ord. 4155 § 1, 1991].

9.43.130 Parking for handicapped persons’ vehicles.

(A)    No person shall park any vehicle in a space designated and marked pursuant to this section as reserved for handicapped persons’ vehicles unless such vehicle displays a valid license plate or placard issued for such vehicle by the California Department of Motor Vehicles pursuant to the provisions of Vehicle Code Section 22511.5, Vehicle Code Section 9105, or any other section of the Vehicle Code providing for issuance of such plates or placards, whether such provision is now in effect or hereinafter enacted.

(B)    Parking spaces designated as handicapped spaces under this section shall be marked in either or both of the following ways:

(1)    Blue paint along the curb or the edge of the pavement immediately adjacent to the parking space;

(2)    A sign consisting of a profile view of a wheelchair with occupant in white on a blue background.

(C)    Violation of this section shall be an infraction with fines as provided by State law. [Ord. 4155 § 1, 1991].

9.43.135 Parking for employees’ vehicles.

Notwithstanding otherwise established parking time limits, parking for employees and owners of businesses located in the core area of the Soquel Village parking and business improvement area may be provided pursuant to an employee/owner permit parking program which shall be administered by the Director of Public Works, or his or her designee. Notwithstanding otherwise established parking time limits, tenants of residential units without on-site parking, where the unit is located in the core area of Soquel Village and was in existence prior to the establishment of the parking district, may be issued an “overnight permit” pursuant to an employee/owner permit parking program which shall be administered by the Director of Public Works, or his or her designee. Parking time limits and locations of said employee/owner parking shall be established by resolution of the Board of Supervisors. The fee for annual employee parking permits shall be established by a resolution of the Board of Supervisors. [Ord. 5248 § 5, 2017; Ord. 5035 § 2, 2009; Ord. 4380 § 5, 1995].

9.43.140 Signposting of parking regulations.

The County of Santa Cruz shall cause appropriate signs to be erected inside and outside the parking zone indicating prominently thereon the parking regulations to be enforced. [Ord. 4155 § 1, 1991].

9.43.150 Enforcement.

The Director of Public Works and his or her designee are authorized to issue citations for any violations of this chapter and to enforce regulations adopted in this chapter by removal of such vehicles pursuant to the authority granted by Vehicle Code Sections 22651(b), (k) and (n). 9.43.160 Violation of this chapter—Penalty.

Unless otherwise specified in this chapter, violation of any of the sections of this chapter shall be subject to a civil penalty, the enforcement of which shall be governed by the civil administrative procedures set forth in Division 17, Chapter 1, Article 3 (commencing with Section 40200) of the California Vehicle Code.
