2.20.003 Community Development Director.

The Community Development Director shall head the Community Development Department, shall be appointed by the City Manager, and shall serve at the discretion of the City Manager. The Community Development Director shall have the responsibility and authority to perform all the functions described by California Government Code Section 65103, and also to carry out any other responsibilities assigned by the City Council, including but not limited to the following:

A. Administer and enforce the provisions of SMC Title 10;

B. Review of projects pursuant to the Subdivision Map Act and SMC Title 9;

C. Review of projects pursuant to the California Environmental Quality Act and SMC Title 11;

D. Research and prepare reports on all Planning Commission applications;

E. Research and make decisions on applications requiring administrative approval;

F. Draft resolutions outlining official actions;

G. Act as Secretary of the Planning Commission; sign resolutions on behalf of Planning Commission and attest to Planning Commission action on final maps;

H. Annually review capital improvement program for consistency with the general plan;

I. Conduct studies and prepare plans and ordinances as directed by the Planning Commission and the City Council;

J. Implement plans and enforce regulations of the Planning Agency;

K. Prepare annual report on status of general plan and progress in its implementation;

L. Review plans and programs of other public agencies for compatibility with City plans and programs;

M. Review City plans for compliance with other local, regional, State and Federal regulations;

N. Prepare and administer Planning Agency budget. [Ord. 1119 § 2, 1996.]

2.20.006 Community Development Department staff.

Except where otherwise provided by this code, the responsibilities of the Community Development Director may also be carried out by Planning Division employees under the supervision of the Director. [Ord. 1205 § 54, 2012; Ord. 1119 § 3, 1996.]

2.20.010 Planning Commission created.

A Planning Commission is created for the City pursuant to the provisions of the planning and zoning law of the State. [Ord. 1119 § 4, 1996.]

2.20.020 Commission qualifications, membership and appointment.

Planning Commissioners shall be residents of the City and shall not hold an office on any other City board, commission or committee established by ordinance, except for the Planning Commission member who sits on the undergrounding committee. Planning Commissioners shall not be City employees.

The Planning Commission shall consist of five members unless the City Council determines, by resolution that the Planning Commission shall consist of seven members. One member shall, when possible, be a landscape architect or arborist. Members of the Planning Commission shall be appointed by the City Council for three-year renewable terms. Any vacancy occurring on the Planning Commission shall be filled by appointment for the unexpired term.

City Council appointments to the Planning Commission shall be governed by the provisions set forth in Chapter 2.58 SMC. [Ord. 1246 § 1, 2017; Ord. 1133 § 2, 1998; Ord. 1120 § 1, 1996; Ord. 1119 § 5, 1996.]

2.20.030 Commission powers and duties.

The Commission shall have such duties and perform such functions as are set forth in the planning and zoning law of the State, and shall also have such duties and perform such functions as may be delegated to it by the City Council, including, without limitation, the duty to perform design review duties except where those duties are assigned to the Zoning Administrator or Planning staff. The Commission shall consider removal/alteration permits and view claim arbitrations and serve as an administration decision-maker in adjudicating disputes arising between claimants and tree owners pursuant to Chapter 11.12 SMC. 2.20.040 Commission compensation.

All members of the Planning Commission may receive compensation as deemed appropriate by the City Council in accordance with the provisions of Section 65252 of the California Government Code. [Ord. 1119 § 7, 1996.]

2.20.050 Majority of Commission constitutes quorum.

A majority (three for a five-member commission, four for a seven-member commission) of members of the Planning Commission shall constitute a quorum for the transaction of business; no action may be taken except by a majority vote of the total membership of the Commission. [Ord. 1119 § 8, 1996.]
