3.32.010 State provisions adopted for care, restitution and disposition – Executions.

A. The City hereby adopts the procedures set forth in California Civil Code Sections 2080.1, 2080.2 and 2080.3 for the care, restitution, sale or destruction of unclaimed property in the possession of the police department or any other department of the City, with the following exceptions:

1. Such unclaimed property except unclaimed bicycles shall be held for a period of at least four months, and unclaimed bicycles shall be held for a period of at least three months; and

2. Thereafter, such property shall be sold at public auction to the highest bidder with notice of such sale being given at least five days before the time fixed therefor by publication once in a newspaper of general circulation published in the County of Marin.

B. If the City Manager determines that any such property which has remained unclaimed for the period set forth above is needed for public use, such property may be retained by the City and need not be sold. [Ord. 797 § 1, 1972.]
