15.26.010 Definition.

As used in this chapter, “passenger bus” means any motor vehicle designed for carrying eight or more passengers and engaged in the transportation of persons for compensation. [Ord. 1046 § 1, 1989.]

15.26.020 Passenger bus operation prohibited.

It is unlawful to operate any passenger bus west of South Street, Second Street, and Bridgeway, except that buses not exceeding an unladen weight of 4.1 tons designed to carry not more than 30 passengers and not exceeding 28 feet in length may be operated on Princess Street from its intersection with Bridgeway to Bulkley Avenue and on Bulkley Avenue from its intersection with Princess Street to the main driveway entrance of the Alta Mira Hotel. No passenger bus may proceed beyond 120 Bulkley Avenue. [Ord. 1046 § 1, 1989.]

15.26.021 Passenger bus operation prohibited – Bridgeway southbound.

It is unlawful to operate any passenger bus southbound on Bridgeway south of Bay Street. This includes southbound travel along the corridor that includes Bridgeway, Richardson Street, Second Street, South Street and Alexander Avenue to the Sausalito city limit. [Ord. 1219 § 2, 2014.]

15.26.022 Passenger bus quiet zone established.

It is unlawful for any passenger bus to operate any public address system, narration system, music, bells, horns, or whistles along the corridor that includes Alexander Avenue beginning at the south city limit and continuing on South Street, Second Street, Richardson Street, and Bridgeway to the north city limit. [Ord. 1219 § 2, 2014.]

15.26.030 Exemptions.

The restrictions contained in this chapter shall not apply to the following:

A. A vehicle transporting school pupils conducted by or under contract with any public or private school;

B. Vehicles operating on a nonprofit basis;

C. Any vehicle exempt under the provisions of State or Federal law. [Ord. 1046 § 1, 1989.]

15.26.040 Signs and markers.

A. The restrictions contained herein shall not be enforced until appropriate signs, markers or other official traffic-control devices have been established giving notice thereof.

B. Provided, however, that the provisions of this chapter shall not be enforced until signs are posted on Princess Street and Bulkley Avenue giving notice of the prohibitions contained herein. [Ord. 1046 § 1, 1989.]

15.26.050 Penalty for violation.

The violation of any provision of this chapter, or failure to comply with any of the mandatory requirements of this chapter, shall constitute a misdemeanor, except that, notwithstanding any other provision of this chapter, any such violation of this chapter may, in the discretion of the enforcement authority, constitute an infraction. If convicted of a misdemeanor, a person shall be subject to payment of a fine, imprisonment, or both, not to exceed the limits set forth in Government Code Section 36901. If convicted of an infraction, a person shall be subject to payment of a fine, not to exceed the limits set forth in Government Code Section 36900. A person, firm, corporation, or organization shall be deemed guilty of a separate offense for each and every day during any portion of which a violation of this section is committed, continued or allowed by the person, firm, corporation or organization, and shall be punishable accordingly.
