10.04.010 Generally.

A. Except as otherwise defined in this title, the definition of any term used in this title is the definition of such term as it is defined and described in the Vehicle Code of the state and amendments thereto.

B. Whenever any words or phrases used in this title are not defined in this chapter but are now defined in the Vehicle Code of the state, such definitions are incorporated in this chapter and shall be deemed to apply to such words and phrases used in this title. 10.04.020 Interpretation.

Whenever in this title the following words and phrases set forth in this chapter are used, they shall for the purpose of this title have the meanings respectively ascribed to them in this chapter. (Ord. 17, 1955; prior code § 9-202)

10.04.030 Alley.

“Alley” means any street less than twenty-five feet in width between property lines. (Ord. 17, 1955; prior code § 9-203)

10.04.040 Central business district.

The “central business district” shall consist of the streets described as follows: Fremont Boulevard, Broadway from the east side of the intersection of Noche Buena Street to the west side of the intersection of Del Monte Boulevard, and Del Monte Boulevard. (Ord. 126, 1957; prior code § 9-204.A)

10.04.050 Central traffic district.

The “central traffic district” shall consist of all streets and portions of streets within the area described as follows: Fremont Boulevard from the north side of the intersection of Military Avenue to the north side of the intersection of Portola Avenue; Del Monte Boulevard from the south city limit to the north city limit; Broadway from the east side of the intersection of Noche Buena Street to the west side of the intersection of Del Monte Boulevard; Palm Avenue from the west side of the intersection of Calaveras Street to the intersection of Del Monte Boulevard. 10.04.055 Commercial vehicle.

A. “Commercial vehicle” means any of the following:

1. Any vehicle as defined in California Vehicle Code Section 260 having a gross vehicular weight of ten thousand pounds or more;

2. Any unattached commercially licensed tractor or truck capable of hauling a trailer or semitrailer resulting in a combined weight of ten thousand pounds or more;

3. Any unattached commercially licensed trailer or semitrailer over eighty inches in width or twenty feet in length.

B. “Commercial vehicle” shall not include a vehicle owned by a public entity or utility. (Ord. 808 § 2, 1992)

10.04.056 Trailer.

“Trailer” shall be as defined by California Vehicle Code Section 630, including trailers for vehicles, boats or personal watercrafts. (Ord. 1027 § 11(2), 2016; Ord. 1010 § 1(B), 2013)

10.04.057 Recreational vehicles.

“Recreational vehicle” shall mean any travel trailer or other vehicular portable structure designed to be used as a temporary occupancy for travel or recreation use, including, but not limited to, any motor home, and truck slide-in camper. Passenger vans which have been converted for use as a recreational vehicle and do not exceed nine feet in height are exempt from this section. (Ord. 1027 § 11(3), 2016)

10.04.058 Prohibited vehicles.

“Prohibited vehicle” shall mean any commercial vehicle, truck tractor, semi-trailer, independent trailer, walk-in van, box van, walk-in truck, trucks with sideboards exceeding the height of the cab, tow truck, any flatbed pickup, any vehicle designed to provide food or equipment sales or transport, any vehicle affixed with power attachments or tools, any vehicle which exceeds a gross vehicle weight rating (GVWR) of eleven thousand five hundred pounds, any school bus or passenger carrying vehicle which exceeds sixteen persons in capacity or twenty-two feet in length, and any vehicle exceeding nine and one-half feet in height. 10.04.060 Council.

“Council” means the council of the city. (Ord. 17, 1955; prior code § 9-205)

10.04.070 Loading zone.

“Loading zone” means that space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers or materials. (Ord. 17, 1955; prior code § 9-206)

10.04.075 Permit parking spaces on city-owned property.

The city council may establish, by resolution from time to time, permit parking spaces in the city off-street parking lots, streets or on other city-owned property. When authorized signs are in place giving notice thereof no person shall stop, stand or park a vehicle in any such space unless such person has displayed a valid, unexpired permit parking sticker. The resolution shall set the yearly or bi-yearly charge for such permit parking and permit parking receipts derived from parking permits shall be credited to the administration of the parking permit program. 10.04.080 Official traffic-control devices.

“Official traffic-control devices” means all signs, signals, markings, and devices not inconsistent with this title, placed or erected by authority of a public body or official having jurisdiction, for the purpose of regulating, warning or guiding traffic. (Ord. 17, 1955; prior code § 9-207)

10.04.090 Official traffic signals.

“Official traffic signals” means any device, whether manually, electrically or mechanically operated, by which traffic is alternately directed to stop and proceed, and which is erected by authority of a public body or official having jurisdiction. (Ord. 17, 1955; prior code § 9-208)

10.04.100 Parkway.

“Parkway” means any portion of a street other than a roadway or sidewalk. (Ord. 17, 1955; prior code § 9-209)

10.04.110 Passenger loading zone.

“Passenger loading zone” means that space adjacent to a curb reserved exclusively for the use of vehicles during the loading or unloading of passengers. (Ord. 17, 1955; prior code § 9-210)

10.04.120 Person.

“Person” means every natural person, firm, copartnership, association, or corporation. (Ord. 17, 1955; prior code § 9-211)

10.04.130 Police officer.

“Police officer” means every officer of the police department of the city. (Ord. 17, 1955; prior code § 9-212)

10.04.140 Shall and may.

“Shall” is mandatory and “may” is permissive. (Ord. 17, 1955; prior code § 9-213)

10.04.150 Stop – Stop or stand – Park.

A. “Stop,” when required, means complete cessation of movement.

B. “Stop or stand,” when prohibited, means any stopping of a vehicle except when necessary to avoid conflict with other traffic or in compliance with the direction of a police officer or official traffic control.

C. “Park” means the standing of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in loading, or unloading, passengers, or materials. (Ord. 17, 1955; prior code § 9-214)

10.04.160 Traffic.

“Traffic” means pedestrians and vehicles, either singly or together, while using any street for the purpose of travel. (Ord. 17, 1955; prior code § 9-215)

“Traffic authority” means the council of the city. (Ord. 17, 1955; prior code § 9-216)
