4.30.010 Sewer user fee.

There is hereby established and assessed against every user of the sanitary sewer system of the Seaside County Sanitation District a fee for the use of said sanitary sewer system in the amount set forth herein. 4.30.020 User defined.

“User” shall mean any person, firm or corporation who makes or maintains a connection to the sanitary sewer system of the Seaside County Sanitation District. For the purpose of establishing liability for payment of said fees, the user shall be rebuttably presumed to be the person, firm, or corporation who has contracted with the servicing public utility for sewer service. 4.30.025 Exemption for SSI recipients.

Every person who is a SSI recipient shall be exempt from the payment of the fee imposed by SCSDC 4.30.010, upon compliance with this section.

“SSI recipient” means every person who meets the criteria of disability as established by the Social Security Administration’s Supplemental Security Income (SSI) Program for the aged, blind, and disabled (Title XVI of the Social Security Act, as amended) and who currently is a SSI recipient.

To be eligible for exemption, a person must file on forms provided by the city of Seaside finance director and provide proof that they are:

A. A SSI recipient; and

B. Jointly or severally liable for payment of the sewer user fee; and

C. The sewer services are used only at their principal place of residence.

Upon completion of the form and qualification, the finance director shall submit the information to the Monterey Regional Water Pollution Control Agency. The exemption shall become effective at the next billing cycle after the Monterey Regional Water Pollution Control Agency has entered the exemption into their records. (Ord. 12 § 1, 1988)

4.30.030 Fees.

The sewer rate increase is based on a 15-year debt scenario spreading the rate increases over a period of six years as shown in the table attached to the ordinance codified in this chapter as Exhibit A and incorporated by this reference. The rates will be increased on an annual basis within the five-year period unless otherwise amended by the district board. 4.30.040 Increased fees.

4.30.050 Collection of fees/delinquencies.

Fees charged pursuant to this chapter shall become due and payable at the same time and in the same manner as the Monterey Regional Water Pollution Control Agency fee. Any fee shall become delinquent if not paid within 30 days after mailing or delivery of notice thereof. Any fee that becomes delinquent shall have added to it a penalty charge equal to 10 percent of the fee that became delinquent. 4.30.060 Monterey Regional Water Pollution Control Agency authorized to collect fees.

The Monterey Regional Water Pollution Control Agency is hereby authorized to collect the fees assessed by this chapter. The Seaside County Sanitation District manager is authorized to execute an agreement with Monterey Regional Water Pollution Control Agency to collect said fees and to pay the Monterey Regional Water Pollution Control Agency its cost of collection. 4.30.070 Implementation date.

The sewer service charge adopted pursuant to this chapter shall be charged from and after July 1, 2017, but in no case sooner than 30 days after the adoption of the ordinance codified in this chapter beginning on the first day of the month thereafter, and shall be billed at the next regular billing cycle, thereafter, of the Monterey Regional Water Pollution Control Agency.
