CITY CLERK AND CITY TREASURER*

1.05.020 City clerk—Restrictions relating to the use of city staff time and/or supplies.

A.    Any work assignment to be performed by city staff members at the direct or indirect request of the city clerk, other than city employees of the office of the city clerk, which exceeds two hours in estimated time for completion shall require a majority vote of approval by the city council. This restriction shall not apply to assignments related to the repair of equipment indispensable to the function of the office of the city clerk, provided there has been compliance with all other city purchasing policies, rules and regulations and codes.

Any work assignment to be performed by city staff members at the direct or indirect request of the city clerk, other than city employees of the office of the city clerk, which exceeds fifty dollars in estimated costs for supplies, materials and equipment use shall require approval by a majority vote by the city council. This restriction shall not apply to assignments related to the repair of equipment indispensable to the function of the office of the city clerk, provided there has been compliance with all other city purchasing policies, rules and regulations and codes.

B.    Penalty. Violation of this section, by the city clerk, shall result in reimbursement to the city for all staff time in excess of two hours and costs of supplies, materials and equipment use in excess of fifty dollars.

C.    The city manager shall establish an administrative policy for the monitoring, regulating and enforcement of this section. The city manager shall be responsible to report to the city council all apparent violations of this section and shall calendar such violations for a hearing before the entire city council to consider the alleged violation and possible penalty.

D.    No punitive or disciplinary action may be taken against any staff member who reports possible violations of this section by the city clerk.

E.    All assignments, tasks or directives from the city clerk to city employees of the office of the city clerk must be related to the duties and responsibilities of such office.

F.    Nothing in this section shall limit or restrict requests of the city clerk which would otherwise be honored for compliance with the Public Records Act (Government Code Section 6200 et seq.), or any other law, statute or ordinance which authorizes action by a city staff member for a member of the general public.

1.05.025 City clerk—Primary responsibilities.

The duties of the city clerk shall be as prescribed in Government Code Sections 40801 through 40814, excluding Sections 40802 through 40805.5 (dealing with the city’s financial affairs and reports), and as otherwise determined or assigned by the city council.

1.05.050 City treasurer—Primary responsibilities.

A.    The primary function of the city treasurer is to disburse monies on demand which have been properly audited and approved, such that once the proper procedures have been followed, the duty of the city treasurer to disburse the funds is mandatory and not discretionary.

B.    The city treasurer is the city official responsible for receiving all daily cash receipts from the city’s departments for the purpose of depositing these monies in the appropriate city account. This function is not intended to be an investment policy decision, but is instead the administrative and ministerial responsibility of the city treasurer.

C.    The city treasurer must comply with all the laws governing deposit and securing of public funds and handling of trust funds in his possession.

D.    The city treasurer is to receive and safely keep all money coming into his hands as treasurer.

E.    The city treasurer must pay out money only on warrants signed by legally designated persons.

F.    Pursuant to Section 1.06.090, the city treasurer shall cooperate with and assist the city manager in administering the affairs of the city most efficiently, economically and harmoniously, so far as may be consistent with their duties as prescribed by law and ordinances of the city.

1.05.060 City treasurer—Business hours.

The business hours for the office of the city treasurer shall be the same days and hours as those designated as the hours of operation for City Hall, as established by the city council.

1.05.065 City treasurer—Compensation.*

Effective on March 6, 2001, the city treasurer shall receive compensation indexed to the remuneration received by a city council member of the city of South Gate, as that compensation is determined and adjusted in accordance with California Government Code Section 36516 and Section 1.04.065.2 of this code.

The city treasurer’s benefits, including medical, dental, life insurance and PERS, and reimbursement for expenses shall be offered on the same basis as those benefits are offered by the city of South Gate to any city council member.

*    Code reviser’s note: Section 3 of Ordinance 2069 provides, “This ordinance, or any provision thereof other than those provisions, if any, which provide for modification by the City Council of the City of South Gate, may only be amended or repealed by approval of a majority of the voters voting on the provisions at any election.”

1.05.070 City clerk—Business hours.

The business hours for the office of the city clerk shall be Monday through Thursday from seven-thirty a.m. to five-thirty p.m., unless other hours of operation for City Hall are designated by the city council.
