9.10.010 Adoption by reference of the Uniform Sign Code.

Except as provided herein, the 1997 Edition of the Uniform Sign Code, including any amendments and appendices thereof, as promulgated and published by the International Conference of Building Officials, is hereby adopted by reference as though fully set forth herein, and shall constitute and is hereby established as “the sign code of the city of South Gate” (“sign code” herein). A copy of the 1997 Edition of the Uniform Sign Code has been deposited in the office of the city clerk and shall at all times be maintained by the city clerk for use and examination by the public.

9.10.020 Violations and penalties.

Any person violating any of the provisions of the sign code shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day, or portion thereof, during which any violation shall be punishable as provided for in Title 1 of this code.

9.10.030 Amendments to sign code.

Notwithstanding the provisions of Section 9.10.010, the sign code is hereby amended by:

A.    Adding a new subsection 103.5 to Section 103 (enforcement) of Chapter 1 (Title, Scope and Enforcement) in its entirety to read as follows:

103.5 Public Nuisance and Abatement

1.    Any sign, advertising display or advertising structure which is erected or maintained in violation of this Sign Code is hereby declared to be a public nuisance and, in addition to all other remedies provided by this Sign Code for its enforcement, the City may initiate a civil action to enjoin the violation of any provisions of this Sign Code.

2.    A violation of this Sign Code shall likewise be deemed to constitute the maintenance of substandard property within the meaning of Chapter 9.48 of this Title and such substandard property shall be subject to the abatement procedures set forth in said Chapter 9.48.

A.    Deleting Section 303 (Exemptions) of Chapter 3 (Permits, Fees, and Inspections in its entirety.

B.    Amending Section 304 (Fees) of Chapter 3 (Permits, Fees and Inspections) in its entirety to read as follows:

304—FEES

Any person requesting a permit required by this Sign Code shall, at the time of application therefor, pay a fee as established herein.

C.    Adding a new Section 307 to Chapter 3 (Permits, Fees and Inspections) to read as follows:

307—SIGN IDENTIFICATION

1.    Name of Responsible Party

Every sign for which a permit is required by this Sign Code shall have affixed to it, in a permanent manner on the surface of the sign or immediately adjacent thereto the name of the person erecting or placing such sign and the date of such placement.

2.    Identification Tag

Every sign for which a permit is required by this Sign Code shall have securely affixed thereon a permit number plate furnished by the City. The erection or use of any such sign without having affixed thereto a permit number plate shall be prima facie evidence that such sign is being maintained in violation of the provisions of this Sign Code, and any such sign shall be subject to immediate abatement as herein provided.
