12.04.010 General.

(a)    Officials and agencies referred to in this title are officials and agencies of the city of South Gate unless the contrary is either stated or implied.

(b)    Whenever any words or phrases used in this title are not defined herein, but are defined in the Subdivision Map Act as last amended, such definitions are incorporated herein and shall be deemed to apply as though set forth in this title.

12.04.020 Word meanings.

(a)    "Advisory agency" means the city planning commission of the city of South Gate.

(b)    "City," "local agency," and "municipality" mean the city of South Gate.

(c)    "City engineer" means the city engineer and director of public works of the city of South Gate.

(d)    "County" means the county of Los Angeles.

(e)    "Design" means:

(1)    Street alignments, grades and widths;

(2)    Drainage, sanitary facilities, and utilities, including alignments and grades thereof;

(3)    Location and size of required easements and rights-of-way;

(4)    Fire roads and fire breaks;

(5)    Lot size and configuration;

(6)    Traffic access;

(7)    Grading;

(8)    Land to be dedicated for park or recreational purposes;

(9)    Such other specific requirements in the plan and configuration of the entire subdivision as may be necessary or convenient to insure conformity to or implementation of the city of South Gate general plan and adopted elements thereof.

(f)    "Director" means the director of community development of the city of South Gate.

(g)    "Tract map" means a final tract map filed for record in the office of the county recorder which shall be required for all subdivisions creating five or more parcels, five or more condominiums as defined in Section 783 of the Civil Code, state of California, or a community apartment project containing five or more parcels, except where:

(1)    The land before division contains less than five acres, each parcel created by the division abuts upon a maintained public street or highway and no dedications or improvements are required by the city of South Gate; or

(2)    The land consists of a parcel or parcels of land having approved access to a public street or highway which comprises part of a tract of land zoned for industrial or commercial development, and which has the approval of the city of South Gate as to street alignment and widths.

(h)    "Installment" means:

(1)    Such street work and utilities to be installed, or agreed to be installed, by the subdivider on the land to be used for public or private streets, highways, ways, and easements, as are necessary for the general use of the lot owners in the subdivision and local neighborhood traffic and drainage needs as a condition precedent to the approval and acceptance of the final map thereof.

(2)    Such other specific improvements or types of improvements, the installation of which, either by the subdivider, by public agencies, by private utilities, by any other entity approved by the city of South Gate, or by a combination thereof, is necessary or convenient to insure conformity to or implementation of the city of South Gate general plan and adopted elements thereof.

(i)     "Parcel map" means a final parcel map filed for record in the office of the county recorder which shall be required when:

(1)    The division of land creates four or fewer parcels; or

(2)    The land before division contains less than five acres, each parcel created by the division abuts upon a maintained public street or highway and no dedication or improvements are required by the city of South Gate; or

(3)    Each parcel created by the division has a gross area of twenty acres or more and has an approved access to a maintained public street or highway; or

(4)    The land consists of a parcel or parcels of land having approved access to a public street or highway which comprises part of a tract of land zoned for industrial or commercial development, and which has the approval of the city of South Gate as to street alignments and widths.

The map shall be waived if the proposed division of land complies with the requirements established in Chapter 12.10, Procedure for Waiving the Requirement for Parcel Map.

(j)    "Tentative parcel map" means a map made for the purpose of showing the design and improvement of a proposed subdivision and the existing conditions in and around it and need not be based upon an accurate or detailed final survey of the property. The map shall be required when:

(1)    The division of land creates four or fewer parcels; or

(2)    The land before division contains less than five acres, each parcel created by the division abuts upon a maintained public street or highway and no dedication or improvements are required by the city of South Gate; or

(3)    Each parcel created by the division has a gross area of twenty acres or more and has an approved access to a maintained public street or highway; or

(4)    The land consists of a parcel or parcels of land having approved access to a public street or highway which comprises part of a tract of land zoned for industrial or commercial development, and which has the approval of the city of South Gate as to street alignments and widths.

The map shall be waived if the proposed division of land complies with the requirements established in Chapter 12.10, Procedure for Waiving the Requirement for Parcel Map.

(k)    "Subdivider" means a person, firm, corporation, partnership or association who proposes to divide, divides, or causes to be divided real property into a subdivision for himself or for others. An employee or consultant of such persons or entities, acting in such capacity, is not a subdivider.

(l)    "Subdivision" means the division of any improved or unimproved land, shown on the latest equalized county assessment roll as a unit or as contiguous units, for the purpose of sale, lease or financing, whether immediate or future except for leases of agricultural land for agricultural purposes. Property shall be considered as contiguous units, even if it is separated by roads, streets, utility easement or railroad rights-of-way. "Subdivision" includes a condominium project, as defined in Section 1350 of the Civil Code, state of California, or a community apartment project, as defined in Section 11004 of the Business and Professions Code, state of California. Any conveyance of land to a governmental agency, public entity or public utility shall not be considered a division of land for any purpose. As used in this title, "agricultural purposes" means the cultivation of food or fiber or the grazing or pasturing of livestock.

(m)    "Tentative tract map" means a map made for the purpose of showing the design and improvement of a proposed subdivision and the existing conditions in and around it and need not be based upon an accurate or detailed final survey of the property. Such map shall be required except where:

(1)    The division of land creates four or fewer parcels; or

(2)    The land before division contains less than five acres, each parcel created by the division abuts upon a maintained public street or highway and no dedication or improvements are required by the city of South Gate; or

(3)    Each parcel created by the division has a gross area of twenty acres or more and has an approved access to a maintained public street or highway; or

(4)    The land consists of a parcel or parcels of land having approved access to a public street or highway which comprises part of a tract of land zoned for industrial or commercial development, and which has the approval of the city of South Gate as to street alignments and widths.

(n)    "Vesting map" is a map of the property containing all the details required for a tentative map and in addition thereto, such of the details as the director of community development or his designate may require to reflect the intended development of the site including, but not limited to building, height, size, location, architectural theme, landscaping and parking plans. Such map shall be required except where same is shown in Section 12.04.020, subdivision (m), (1), (2), (3) and (4). Furthermore, it shall have printed conspicuously on its face, the words "Vesting Tentative Map" at the time it is filed with the city. (Ord. 1684 § 1, 1-13-86).
