5.10.010 Public nuisance.

Where the fire chief or his/her designee determines that an owner, agent, lessee or other person occupying or having charge or control of any building, lot or premises within the city limits has permitted combustible vegetation, including, but not limited to, weeds, shrubs, and/or trees, to remain upon said premises or public right-of-way in such a condition that, pursuant to the fire chief or his/her designee’s judgment, constitutes a fire hazard, such condition shall be deemed a public nuisance. 5.10.020 Permits.

Any person who shall commence any work for which a permit is required by this code without first having obtained a permit therefor shall, if subsequently permitted to obtain a permit, pay double the permit fee fixed by this section for such work; provided, however, that this provision shall not apply to emergency work when it shall be proved to the satisfaction of the fire department that such work was urgently necessary and that it was not practical to do so, and if there be an unreasonable delay in obtaining such permit, a double fee as herein provided shall be charged. 5.10.030 Fire service fees.

a) Fire service fees may be charged to any person, firm, corporation or business that through negligence, violation of the law, or as a result of carelessness is responsible for the cause of the fire department to respond to the scene of an incident. The fee shall not exceed the actual cost of suppressing the fire and/or responding to the scene of an incident.

b) Fire Department Permit, Plan Check and Inspection Fees. The city council shall adopt, by separate resolution(s), a schedule of fees establishing fees and charges for various fire department services including plan checking, inspections, the issuance of permits and administrative citations. 5.10.040 Penalties and citations.

a) Whenever a violation of this chapter has occurred, the fire chief or his/her designee may issue administrative citations in accordance with Chapter 1.15 SLTCC.

b) Any person, company, entity, group or landowner operating or maintaining any occupancy, premises, or vehicle subject to this code who shall permit a fire hazard to exist on premises under his or her control shall be guilty of an infraction.

c) Any person, company, entity, group or landowner operating or maintaining any occupancy, premises or vehicle subject to this code who shall permit any fire hazard to exist on premises under their control which causes personal injury or property damage, or who fails to take immediate action to abate a fire hazard when ordered or notified to do so by the fire chief or his/her designee, shall be guilty of a misdemeanor.

d) Any person violating any section of this title after failing to remedy such violation after having been notified to do so by the fire chief or his/her designee shall be guilty of a misdemeanor. (Ord. 1080 § 1 (Exh. A))

5.10.050 Abatement.

a) The fire chief or his/her designee shall cause combustible vegetation or other fire hazards to be abated through mowing, cutting, removal or any other method deemed safe by the fire chief or his/her designee.

b) When the fire chief or his/her designee determines that total removal of combustible vegetation growth is impractical due to size or environmental factors, approved fuel breaks shall be established. Designated areas shall be cleared of combustible vegetation to establish fuel breaks.

c) Any property owner shall have the right to abate such combustible vegetation or fire hazards on their property themselves, or have the same abated at their own expense. (Ord. 1080 § 1 (Exh. A))

5.10.060 Board of appeals.

Where references in this chapter and the California Fire Code are made to a “board of appeals,” such provision shall be deemed to refer to the building board of appeals established by this code. (Ord. 1080 § 1 (Exh. A))
