CHAPTER 21. ISSUANCE OF CITATIONS

1-21-1000 ISSUANCE OF CITATIONS: RESOURCE MANAGEMENT AGENCY:

In accordance with section 836.5 of the California Penal Code, the Director of the Resource Management Agency, the Assistant Director, the Supervising Building Inspector, and the several classes of Building-Zoning Inspectors are hereby authorized to make arrests without warrants for the violation of the following Ordinances which they have the duty to enforce:

(a)    Tulare County Ordinance No. 352, as amended.

(b)    Chapter 9 (commencing with section 4-09-1000) of Part IV of this Ordinance Code.

(c)    Article 7 (commencing with section 5-01-1200) of Chapter 1 of Part V of this Ordinance Code.

(d)    Part VI of this Ordinance Code.

(e)    Chapter 11 (commencing with section 7-11-1000) of Part VII of this Ordinance Code.

(f)    Article 1 (commencing with section 7-15-1000) of Chapter 15 of Part VII of this Ordinance Code.

(g)    Article 5 (commencing with section 7-15-1210) of Chapter 15 of Part VII of this Ordinance Code.

(h)    Article 7 (commencing with section 7-15-1350) of Chapter 15 of Part VII of this Ordinance Code.

(i)    Article 9 (commencing with section 7-15-1485) of Chapter 15 of Part VII of this Ordinance Code.

(j)    Article 11 (commencing with section 7-15-1565) of Chapter 15 of Part VII of this Ordinance Code.

(k)    Article 13 (commencing with section 7-15-1650) of Chapter 15 of Part VII of this Ordinance Code.

(l)    Chapter 19 (commencing with section 7-19-1000) of Part VII of this Ordinance Code.

(m)    Chapter 27 (commencing with section 7-27-1000) of Part VII of this Ordinance Code.

(n)    Chapter 27 (commencing with section 4-27-1000) of Part IV of this Ordinance Code.

(o)    Chapter 9 (commencing with section 8-09-1000) of Part VIII of this Ordinance Code.

Such arrests, including the issuance of citations, shall be made in conformity with said section 836.5 and the statutes referred to therein.

1-21-1005 SAME: ANIMAL CONTROL OFFICERS:

(a)    Animal Control Officers are public officers as defined in Penal Code section 836.5 with the authority and immunity to enforce the provisions of this Chapter.

(b)    The Animal Control Officer may enter upon any property pursuant to law to ascertain if any of the provisions of this Chapter or any state law relating to the care, treatment or impound of animals is being violated.

(c)    The Animal Control Officer is authorized to issue citations whenever he or she has reasonable cause to believe that the person has committed a misdemeanor or infraction in his presence, which is a violation of State law and for violations of Chapter 7 (commencing with section 4-07-1000) of Part IV of this Ordinance Code.

(d)    Pursuant to the provisions of Penal Code section 836.5, any employee of the Animal Control Division who is qualified under section 830.9 of the Penal Code as an Animal Control Officer is authorized to carry a tranquilizer gun and other animal control devices in common use within the State.

(e)    The authority of such Animal Control Officers is limited to the issuance within the boundaries of the County of Tulare of such citations and notices to appear.

(f)    Animal Control Officers are public officers and their authority under this Chapter does not include the powers of arrest.

1-21-1010 SAME: AGRICULTURAL COMMISSIONER/SEALER:

In accordance with section 836.5 of the California Penal Code, the Tulare County Agricultural Commissioner/Sealer, the Assistant Agricultural Commissioner/Sealer, the several classes of Deputies Agricultural Commissioner/Sealer, and the several classes of Agriculture and Standards Inspectors are hereby authorized to make arrests without warrants for the violation of the following portions of this Ordinance Code which they have the duty to enforce:

(a)    Article 2 (commencing with section 6-05-2000) of Chapter 5 of Part VI, regarding apiaries.

(b)    Article 4 (commencing with section 6-05-4000) of Chapter 5 of Part VI, regarding citrus fruit harvesting containers.

(c)    Article 9 (commencing with section 6-05-9000) of Chapter 5 of Part VI, regarding weighing and measuring instruments.

Such arrests, including the issuance of citations, shall be made in conformity with said section 836.5 and the statutes referred to therein.

1-21-1015 SAME: PARKS OFFICERS:

The Tulare County General Services Director, the Tulare County Parks Superintendent, and the several classes of Parks Attendants are authorized to issue citations for violations of law committed within any Tulare County Park as are authorized by section 836.5 of the Penal Code of the State of California for the enforcement of the following portions of the Ordinance Code:

(a)    Article 3 (commencing with section 2-05-1060) of Chapter 5 of Part II; Boating, Water Skiing and Swimming.

(b)    Article 5 (commencing with section 2-05-1210) of Chapter 5 of Part II. Use of County Parks.

The issuance of citations shall be made in conformity with said section 836.5 and the statutes referred to therein.

1-21-1020 SAME: FIRE CHIEF’S OFFICE:

The several classes of Fire Inspectors, Fire Investigators, and Hazard Abatement Officers appointed by the Tulare County Fire Chief are authorized to issue citations for violations of law committed within the County as authorized by section 836.5 of the Penal Code of the State of California for the enforcement of the following sections of the Ordinance Code of Tulare County:

(a)    Chapter 11 (commencing with section 4-11-1000) of Part IV of this Ordinance Code.

(b)    Article 3 (commencing with section 7-15-1115) of Chapter 15 of Part VII of this Ordinance Code.

(c)    Article 17 (commencing with section 7-15-1810) of Chapter 15 of Part VII of this Ordinance Code.

The issuance of citations shall be made in conformity with said section 836.5 of the Penal Code and the statutes referred to therein.

1-21-1025 SAME: HEALTH OFFICER:

The Tulare County Health Officer and her or his authorized deputies are authorized to issue citations for violations of law committed within the County as authorized by section 836.5 of the Penal Code for the enforcement of the following sections of the Ordinance Code of Tulare County:

The issuance of citations shall be made in conformity with section 836.5 of the Penal Code and the statutes referred to therein.
