Article 1. Voting Members

2-2-101 Eligibility to vote.

No employee or officer of the City, other than an elected officer who is also a member of any board or commission created or appointed by the Council, shall have the right or authority to vote on any matter or proposition coming before such board or commission for decision, nor shall such officer or employee be counted as one of the members of such board or commission constituting a quorum thereof.

Article 2. Planning Commission

2-2-201 Membership.

(a) Members. The Planning Commission shall consist of seven (7) members appointed by the Mayor with the approval of the Council.

(b) Alternate members. The Mayor, with the approval of the City Council, may appoint two (2) alternate members to the Commission. An alternate Commissioner shall serve as a voting member in the absence of a regular member.

(c) Qualifications. Only residents of the City of Turlock shall be eligible for appointment to the Planning Commission. If, during his or her term on the Commission, a Commissioner ceases to reside within the City limits, such seat on the Commission shall immediately become vacant.

2-2-202 Membership: Term.

(a) Members. Of the members first appointed to the Planning Commission, one (1) shall be appointed for a term of one (1) year, two (2) for terms of two (2) years, two (2) for terms of three (3) years, and two (2) for terms of four (4) years. Their successors shall be appointed for terms of four (4) years.

(b) Alternate members. The alternate members shall be appointed for a term of two (2) years beginning April 1st.

(c) Limitations: Members. The terms for members of the Planning Commission shall be limited to a maximum of twelve (12) consecutive years or until the completion of the term if the twelve (12) year period falls within an unexpired term of a member. In determining the maximum term of a member of the Planning Commission, any time served as an alternate member shall not be counted.

(d) Limitations: Alternate members. The terms for alternate members shall be limited to a maximum of four (4) consecutive years or until the completion of the term if the four (4) year period falls within an unexpired term of an alternate member.

2-2-203 Membership: Vacancies.

If a vacancy in the membership of the Planning Commission shall occur other than by the expiration of the term, such vacancy shall be filled by appointment for the unexpired portion of the term.

2-2-204 Powers and duties.

The Planning Commission shall have such powers and duties as are provided by Sections 65100 et seq. of the Government Code of the State and such other authority as may be conferred upon the Commission by law, except that the provisions of subsection (a) of Section 65402 of the Government Code of the State shall not apply to (a) the disposition of the remainder of a larger parcel which was acquired and used in part for street purposes; (b) acquisitions, dispositions, or abandonments for street widening; or (c) alignment projects, provided such dispositions for street purposes, acquisitions, dispositions, or abandonments for street widening, or alignment projects are of a minor nature.
