8-9-01 Purposes.

The purposes of this chapter are to provide minimum standards to safeguard life, health, property, and the public welfare by regulating and controlling the design, construction, quality of materials, use and occupancy, location, and maintenance of all buildings and structures within the corporate limits of the City.

8-9-02 Adoption.

That certain document in book form entitled "Uniform Solar Energy Code, 1997 Edition," including the supplements, as compiled and published by the International Association of Plumbing and Mechanical Officials, 20001 Walnut Drive South, Walnut, California, 91789, referred to and by such reference incorporated herein, is hereby adopted by the City as the Solar Energy Code of the City. Said Uniform Solar Energy Code, 1997 Edition, certified by the City Clerk, shall be filed and will be kept on file for use and examination by the public in the office of the City Clerk.

8-9-03 Validity.

If any section, subsection, sentence, clause, or phrase of this chapter is for any reason held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this chapter. The Council hereby declares that it would have passed this chapter and every section, subsection, sentence, clause, and phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clause, or phrases be declared unconstitutional.

8-9-04 Board of Appeals.

Section 20.13 of said Uniform Solar Energy Code is hereby amended to read as follows:

SECTION 20.13. Board of Appeals. The City Council shall act as a Board of Appeals in making a determination of any appeal arising from actions of the Administrative Authority. Appeals shall be made as provided by Title 1, Chapter 4 of this Code. The appellant shall cause to be made at his own expense any tests or research required by the Board to substantiate his claims.
