2.44.010 Definitions.

The following words and phrases, when used in this chapter, shall, for the purpose of this chapter, have the meanings respectively ascribed to them in this section:

A. “Chief” means the chief of police of the city.

B. “Member” means a member of the Vacaville police reserve.

C. “Reserve” means the Vacaville police reserve. (Prior code §15.1).

2.44.020 Rules and regulations.

The chief of police is authorized, directed and empowered to prepare and promulgate such rules and regulations and any revisions or amendments thereof as may be in his discretion necessary to carry out the express intent of this chapter. (Prior code §15.2).

2.44.030 Created.

The City Police Reserve is created and established. The reserve of not more than 25 persons shall be appointed by the City Manager on the recommendation of the Chief of Police and shall be under the direction of the Chief of Police. (Prior code §15.3).

2.44.040 Eligibility.

To be eligible to membership in the reserve each applicant must indicate his willingness to serve an average minimum of eight hours per month in the public service. (Prior code §15.4).

2.44.050 Qualifications and standards.

The chief of police shall, by rule promulgated by him, prescribe the qualifications and standards by which applicants for membership in the reserve shall be governed and persons possessing the qualifications and conforming to the standards may be appointed to the reserve. (Prior code §15.5).

2.44.060 Compensation.

The amount and method of payment of compensation for the reserve shall be as fixed by resolution of the city council duly passed and adopted. (Prior code 615.6).

2.44.070 Performance of duties.

Members of the reserve shall perform only such public service as may be ordered by the chief of police and it is unlawful for any person to willfully resist, delay or obstruct any member in the discharge or attempt to discharge any duties of his office. (Prior code §15.7).

2.44.080 Disaster duties.

In addition to the duties assigned by the chief of police, the reserve is assigned the duty of preparing against the perils to civilian life and property that may be expected to result from attack from or during war or from any disaster that may threaten lives and property in the city. 2.44.090 Peace officer duties.

In the enforcement of the penal laws of the state, or the penal laws of the city, and in performance of such other duties as may be designated by the chief of police, every duly authorized member, while on duty, shall be deemed to have all the powers of a peace officer. (Prior code §15.9).

2.44.100 Public officer duties.

All persons appointed to the reserve by the city administrator, pursuant to the provisions of this chapter, shall be deemed public officers. (Prior code §15.10).

2.44.110 Uniform – Issuance.

The uniform, badge and equipment to be worn and carried by the members, while on duty only, shall be as prescribed by the chief of police. (Prior code §15.11).

2.44.120 Uniform – Surrender.

Upon separation of any person from the reserve, the badge, identification card and cap shield issued to him shall be returned to the chief of police and the member so returning such items shall be entitled to no compensation therefor. (Prior code §15.12).

2.44.130 Service time.

Each member of the reserve must serve a minimum of eight hours per month in the public service. (Prior code §15.13).

2.44.140 Dismissal.

Where any member has failed to give the minimum hours of service to the reserve required by Section 2.44.130 for a period of one month, the chief of police shall inquire into the reasons therefor and, unless good reason is shown for the failure to render the minimum hours required, the chief of police may recommend to the city administrator the dismissal of the member from the reserve. The city administrator, upon recommendation of the chief of police may dismiss a member from the reserve without any hearing whatsoever. (Prior code §15.14).

2.44.150 Resignation.

Each member shall have the right to resign from the reserve at any time. (Prior code §15.15).

2.44.160 Disaster council registration.

Each member of the reserve shall be registered with an accredited disaster council. (Prior code §15.16).

2.44.170 Impersonation prohibited.

It is unlawful for any person to impersonate or falsely represent himself to be a member of, or to wear, use or possess a badge used by, the reserve. (Prior code §15.17).
