TRUCKS AND TRUCK ROUTES WITHIN THE CITY LIMITS

10.32.010 Definitions.
For the purpose of this chapter, unless it is plainly evident from the context that a different meaning is intended, certain terms used in this chapter are defined as follows:
“Central business district” is that portion of the City bordered on the west by Cernon Street, on the north by Monte Vista Avenue, on the east by McClellan Street, and on the south by Mason Street.
“City” means the most current corporate limits of the City.
“Destination” or “destinations” means either a single delivery or multiple deliveries of goods or services to an address within or outside the City.
“Extra-legal vehicle” means any vehicle or combination of vehicles or special mobile equipment that exceeds the size or weight specified in Sections 35000 through 35796 of the California Vehicle Code.
“Restricted street” means all streets in the City except truck routes as established in this chapter.
“Truck” means any vehicle exceeding a gross vehicle weight rating of five tons.
“Truck route” means any street as designated in this chapter upon which the unrestricted use of trucks is permitted.

10.32.020 Restrictions in the central business district.
No operator of the following vehicles shall drive the same in the central business district between the hours of twelve noon and six p.m., except for the purposes of loading and unloading:
A. Any vehicle so loaded that any part of its load extends more than three feet to the front or more than 10 feet to the rear of said vehicle;
B. Any truck as so defined in this chapter.

10.32.030 Trucks prohibited on restricted streets.
A. All streets or parts of streets in the City other than those designated in this chapter as truck routes are designated as restricted streets.
B. When appropriate signs are erected on truck routes as hereinafter established, no person shall operate, drive or cause or permit to be operated or be driven, any truck on any restricted street except as hereinafter provided. (Ord. 1434 §11, 1991: Ord. 1312 §1(part), 1987).

10.32.040 Truck routes established.
A. The streets designated as extra-legal vehicle routes in Section 10.32.130.C (including alternate routes for wide loads) together with the following named streets are declared to be truck routes for the movement of trucks except as set forth in Subsection C of this section:

B. The Director of Public Works is authorized and directed to designate such streets by appropriate signs as “truck route” which method of designation the City Council has determined will best serve to give notice of this chapter. It is unlawful to operate or move a truck on a restricted street. (Ord. 1448 §5, 1991: Ord. 1312 §1(part), 1987).
C. Leisure Town Road, from Orange Drive to Alamo Drive, is not designated as a truck route, pursuant to Section 10.32.030.

10.32.060 Truck traffic originating outside the City.
A. Entering City. No truck shall enter or leave the City except on a truck route.
B. Outside Destination, Through Traffic. All trucks entering the City for destinations outside the City shall operate only over a truck route.
C. Inside Destination. All trucks entering the City for destinations in the City shall proceed only over a truck route and shall deviate therefrom only by the shortest and most direct route between each destination and the nearest truck route. (Ord. 1312 §1 (part), 1987).

10.32.070 Truck traffic originating inside the City.
A. Portion of Trip Outside of City. If any portion of a truck’s trip is outside of the City even though its origin is inside the City it shall be considered as an outside origin trip upon re-entry into the City and Section 10.32.060 shall apply.
B. Outside Destinations. All trucks on a trip originating in the City and traveling in the City for destinations outside the City shall proceed by the shortest and most direct route to the nearest truck route.
C. Inside Destination. All trucks on a trip originating in the City and traveling entirely within the City for destinations in the City shall proceed by the shortest and most direct route to the nearest truck route, and shall deviate therefrom only by the shortest and most direct route between each destination and the nearest truck route. 10.32.080 Weigh-in.
Any police officer shall have the authority to require any person driving or in control of any commercial vehicle not proceeding over a truck route to proceed to any public or private scale available for the purpose of weighing and determine whether this chapter has been complied with. 10.32.090 Exceptions.
A. The provisions of this chapter shall not prohibit the operation of any truck coming from a truck route having ingress or egress by direct route to and from a restricted street when necessary for the purpose of making pickups or deliveries of goods, wares and merchandise from or to any building or structure located on the restricted street or for the purpose of delivering materials to be used in the actual and bona fide repair, alteration, remodeling, or construction of any building or structure upon the restricted street for which a building permit has previously been obtained so long as the operator of such truck takes a route prescribed in Section 10.32.040.
B. The provisions of this chapter shall not apply to:
1. Passenger buses under the jurisdiction of the Public Utilities Commission and school buses.
2. Any vehicle owned or operated by the City, or used for the removal of refuse under contract with the City, or by a public utility or licensed contractor while necessarily in use in the construction, installation repair of any facility, within the City.
3. Any authorized emergency vehicle. (Ord. 1312 §1(part), 1987).

10.32.100 Extra-legal vehicle permits.
The City, as empowered by California Vehicle Code Sections 35780 and 35790 and subject to the limitations, restrictions, and conditions imposed by that Code, will, at its discretion and if good cause appears, issue a special or annual permit authorizing the permittee to:
A. Operate or move a vehicle or combination of vehicles or special mobile equipment that exceeds the maximum legal weight and/or size specified in Sections 35000 through 35796 of the California Vehicle Code. It is unlawful to operate or move an extra-legal vehicle on any public street or alley in the City without a special or annual extra-legal vehicle permit;
B. Move any manufactured home in excess of the maximum width, length, and height, pursuant to Sections 35790 through 35790.6 of the California Vehicle Code. Moving such a manufactured home without a permit is unlawful.

10.32.110 Application for extra-legal vehicle permits.
A. The permits described in Section 10.32.100 shall be procured by applying to the Director of Public Works. The application shall conform with the requirements of the California Department of Transportation.
B. The application shall be submitted not less than 24 hours in advance of the time for which the permit is needed, unless the Director of Public Works determines that additional time is needed to review or process the application, in which case the Director shall notify the applicant of the additional time needed. The Director may also grant exceptions to the 24-hour requirement when, in the judgment of the Director, circumstances require that the application be reviewed and processed in less than 24 hours.

10.32.120 Extra-legal vehicle permit fees.
The Director of Public Works shall collect from the applicant at the time of application a fee for a special extra-legal vehicle permit or a fee for an annual extra-legal vehicle permit in order to defer the cost of processing the application. The amount of such fees shall be established by resolution of the City Council, as may be amended from time to time.

10.32.130 Restrictions on extra-legal load permits.
Should the Director of Public Works approve an application for an extra-legal vehicle permit, the permit shall be subject to the following conditions, provisions, and restrictions:
A. The extra-legal vehicle permit must be carried on the vehicle for which it was issued. The permit must be displayed upon demand to any peace officer, traffic officer, or other officer or employee of the City charged with the care and protection of the highways.
B. Extra-legal vehicle permittees are prohibited from using city streets or alleys between the hours of seven a.m. to nine a.m., noon to one p.m., and four p.m. to six p.m. Monday through Friday.
C. Extra-legal vehicles shall be limited to the following City streets:

D. Any conditions by the Director of Public Works further limiting the streets that the described vehicle or vehicles may use or prescribing the route that the described vehicle or vehicles must use.
E. Any conditions, provisions, or restrictions deemed appropriate by the Chief of Police including, but not limited to:
1. Limiting the number of trips that the described vehicle may make;
2. Establishing seasonal or further time limitations within which the vehicle or vehicles described may be operated;
3. Requiring proof of financial responsibility in excess of the amount required for compliance with California Vehicle Code Section 16500.5 as a condition for granting a permit for unusually large or heavy loads which pose a substantial risk to public facilities.
F. Any other conditions, provisions, or restrictions mandated by this code or the California Vehicle Code.

10.32.140 Appeals.
A. An applicant who has been denied an extra-legal load permit or who wishes to appeal a condition imposed by the chief of police in accordance with Section 10.32.130.E may appeal such denial or condition in the manner specified in this section.
B. Within five days following the date of denial or issuance of the permit, the applicant shall file the appeal with the Director of Public Works, together with an appeal fee to defer the cost of processing the appeal. The amount of the fee shall be established by resolution of the City Council, as may be amended from time to time. The appeal shall be in writing and shall state the reason(s) for the appeal. The Director shall report the appeal to the City Manager, who may deny the appeal or grant the appeal with or without additional conditions. The decision of the City Manager shall be final.
