10.54.010 Definitions.

A. “Business district” means and includes a business district as defined in Vehicle Code Section 235 as amended from time to time.

B. “Community center(s)” includes individually and together those public facilities commonly known as McBride Senior Center, Three Oaks Community Center, and Ulatis Community Center and for purposes of this chapter includes the buildings that comprise each community center and the walkways, plaza areas, and pedestrian and seating areas adjacent to the buildings, but does not include the parking lots adjacent to the community centers.

C. “Publicly used private property” means any privately owned real property and improvements held open by its owners for access or use by the public, including but not limited to retail and department stores, shopping centers and shopping malls, grocery stores, business offices, professional and administrative offices, banks and other financial institutions, hotels and motels, multi-family residential complexes consisting of more than four dwelling units, churches, hospitals and restaurants and privately owned sidewalks and walkways included on or associated with such real property and improvements.

D. “Skateboards,” “roller skates,” and “non-motorized wheeled vehicles” include all forms of self-propelled devices by which persons ride on wheels, whether in-line skates or not, and which are not motorized vehicles or bicycles as defined by California law. In addition to skateboards and roller skates, this definition includes, but is not limited to, tricycles that are not propelled with the assistance of a belt, chain or gears, wheeled sleds, non-motorized scooters, and all wheeled toys including those often referred to as “big wheels.” Wheelchairs, whether motorized or not, are not regulated by this chapter and may be used throughout the city so long as used with due care towards others using public sidewalks, parks, trails, and other rights-of-way.

E. “Social services center” means and includes the buildings, facilities, sidewalks, walkways and adjacent areas located at 40 Eldridge Avenue, at the corner of Buck Avenue and Eldridge Avenue.

F. “Town Square” means and includes the public plaza located between Main Street and a parallel line approximately 100 feet north of Main Street, and east of No. 21 Town Square, and west of No. 11 Town Square.

G. “Transit Plaza” means and includes the public transit center located at the southeast corner of the intersection of Monte Vista Avenue and Cernon Street, commonly known as the Vacaville Transit Plaza, and further defined as the portion of APN 130-093-130 which has been developed to serve as a public transportation center, including on-site driveways, walkways, benches, bus shelters, and landscape areas.

10.54.020 Limitation on use of skateboards, roller skates and non-motorized wheeled vehicles in commercial zoning districts.

10.54.030 Limitation on use and use of skateboards, roller skates and non-motorized wheeled vehicles.

A. Except as set forth in subsection B of this section, skateboards, roller skates, and other non-motorized wheeled vehicles may not be used, ridden, or otherwise operated in, through or across public parks, Andrews Park, community centers, the social services center, the Town Square, the Transit Plaza, public park and ride lots, publicly used private property, or on sidewalks or walkways in any business district, when signs are posted as provided in this chapter.

B. Skateboards, roller skates, and other non-motorized wheeled vehicles may be used, ridden or otherwise operated on the citywide bike-path system and on roads and paths in city parks, except Andrews Park and any other park designated by the city manager pursuant to Section 12.28.120.A, so long as done so with due care for the use, availability, and enjoyment of those facilities by other citizens. No person shall ride or propel themselves by skateboard, roller skates, or other non-motorized vehicle on any public property, park, or other public facility without exercising due care and without wearing appropriate safety gear.

C. Use, riding, or other operation of skateboards, roller skates, and any non-motorized wheeled vehicles is strictly prohibited in Andrews Park.

D. Use, riding, or other operation of a skateboard, roller skates, or any non-motorized wheeled vehicle on sidewalks in residential areas shall be permissible only when exercising due care and giving proper regard for the safety and right-of-way of pedestrians.

10.54.040 Prohibition on “tricks” and “jumps.”

Public property may not be used to propel for “tricks,” “jumps” or other acts of skill on skateboards, roller skates or non-motorized wheeled vehicles except in locations specifically designated for such use.

10.54.050 Unattended skateboards, roller skates and non-motorized wheeled vehicles on public property, parks and other public facilities.

Skateboards, roller skates, and other non-motorized wheeled vehicles shall not be left unattended on public property, parks, and other public facilities in any place or position where other persons may trip over or be injured by them.

10.54.060 Use of skateboard park facilities owned or operated by the city.

A. Use, riding, or operation of any bicycle is strictly prohibited at any city-owned or city-controlled skateboard park facility.

B. Required Safety Gear. No person shall use a skateboard park facility owned or operated by the city unless such person is wearing a properly fastened helmet, elbow pads and knee pads.

C. Use of Skateboard Park Facilities by Persons under the Age of 12. No person under the age of 12 shall use a skateboard park facility owned or operated by the City unless such person is accompanied and supervised at all times by an adult.

10.54.070 Signage.

A. The provisions of this chapter shall apply only to those areas, facilities, business districts and publicly used private properties which have conspicuously posted at all entrances to the property or along the boundaries of the property signage acceptable in form, location, and substance to the City’s Public Works Director and the Chief of Police, or their authorized designees.

B. No sign restricting the use of skateboards, roller skates and other non-motorized wheeled vehicles shalt be posted on publicly used private property or in any business district without the prior written approval from the City Manager or the City Manager’s designee. The City Manager shall approve posting the property only if he or she finds the use or riding of skateboards, roller skates, or other non-motorized wheeled vehicles on such publicly used private property or within such business district will endanger pedestrian traffic or public safety.

10.54.080 Penalty for violation.

A. The penalty for violation of this chapter shall be as set forth in Chapter 10.56 of this code.

B. Where this chapter has been violated more than once in a 72-hour period by a person under the age of 18 years, in lieu of a fine and imprisonment the Chief of Police or his/her designee may impound the skateboard, roller skates, or other non-motorized wheeled vehicle for a period not to exceed 30 days. When a skateboard, roller skates or other non-motorized wheeled vehicle used in violation of this chapter is impounded, the parent or guardian of the juvenile shall be responsible for paying the administrative costs of forty dollars for processing and storing the item. The administrative costs may be revised from time to time by resolution of the City Council.
