PRIVATELY FINANCED MAINS AND LATERALS

4.30.010 Connecting to privately financed mains and laterals.

Whenever a main or lateral sewer has been constructed entirely by private financing under a written agreement with WCW providing for reimbursement, and the main or lateral sewer is located such that intervening, connecting or adjacent real property can be connected to it, any connection or connections may be made after a permit is obtained, upon compliance with applicable ordinances, rules and regulations of the district and upon the payment, in addition to all other fees, rates and charges prescribed, of a capacity charge in a sum which the general manager shall determine as the pro rata amount such property with respect to which the permit is sought would have contributed to the cost of such main or lateral sewer had it participated in the original private financing thereof, plus interest as may be provided by the written agreement, not to exceed six percent per annum, simple interest. 4.30.020 Reimbursement of original permittee.

If a permit or permits for such connection or connections is or are granted within 10 years after completion of such main or lateral sewer, the sums so collected, with said interest, shall be paid over by the district to the person or persons who procured the original permit for and installed the main or lateral sewer to which such connection or connections is or are made; provided, that no such refund or payment shall in the aggregate exceed the original cost of such original installation and said interest. Any balance over and above the cost of such original installation and said interest, and all fees received and not required to be paid over or refunded as herein provided, shall remain the property of the West County Wastewater District. 4.30.030 Payments due.

All payments and computations under this chapter shall be made at least once each year upon a date selected by the general manager upon the basis of records of original installation cost on file in the office of the West County Wastewater District. [Ord. 2023-004 § 6.030]
