10.28.010 Effect on regulations.

A.    It is a misdemeanor or an infraction for any person to do any act forbidden, or fail to perform any act required in this chapter.

B.    The parent or guardian of any child shall not authorize, or knowingly permit, any child to violate any of the provisions of this chapter.

C.    These regulations applicable to bicycles shall apply whenever a bicycle is operated upon any highway, street, alley, or upon any path set aside for the exclusive use of bicycles subject to those exceptions stated herein. (Prior code § 4-2.01)

10.28.020 Traffic laws apply to persons operating bicycles.

A.    Every person riding a bicycle upon a roadway shall be granted all the rights and shall be subject to all of the duties applicable to the driver of a vehicle by the laws of this state declaring rules of the road applicable to the driver of a vehicle, except as to those provisions of laws and ordinances which, by their nature, can have no application.

B.    Every person operating a bicycle shall obey the instructions of official traffic control signals, signs and other control devices applicable to vehicles, unless otherwise directed by a police officer.

C.    Persons riding bicycles upon a roadway shall not ride more than two abreast except on paths or parts of roadways set aside for the exclusive use of bicycles.

D.    Whenever a usable path for bicycles has been provided adjacent to a roadway, bicycle riders shall use such path and shall not use the roadway.

E.    No person shall operate a bicycle at a speed greater than is reasonable and prudent under conditions then existing or at a speed in excess of the posted speed limits.

F.    The operator of a bicycle emerging from an alley, driveway or building shall, upon approaching a sidewalk area extending across any such entry, yield the right of way to all pedestrians approaching on the sidewalk or sidewalk area, and upon entering the roadway, shall yield the right of way to all vehicles approaching on the roadway.

G.    It is unlawful for any person to ride, wheel, or in any other way to propel a bicycle upon the sidewalks of the city, except that a person may wheel a bicycle across the sidewalk for the purpose of parking same at a city designated bicycle parking area.

H.    Bicycles shall not be parked or left upon any sidewalk, except at a city designated bicycle parking area. (Prior code § 4-2.02)

10.28.030 Enforcement and penalty.

The police department is required to enforce the provisions of this chapter.

A.    Any person found guilty of an infraction or misdemeanor under this chapter shall be punished by a fine of not more than fifty dollars ($50.00).

B.    However, when any provision of this chapter or the state law with respect to bicycles has been violated by any juvenile under eighteen (18) years of age, then in lieu of the instigation of criminal proceeding, or of proceedings of, and in, the juvenile court, the chief of police may prohibit operation upon any street, alley, sidewalk, or other public way, or in public places of the city for a period not to exceed thirty (30) days, of a bicycle so used in said violation, and in such event, the bicycle so used by be impounded by the chief of police and retained by him or her during the period that operation is prohibited.
