5.48.010 General purpose and definition.

The general purpose of the ordinance codified in this chapter is to allow vending from ice cream trucks under the conditions set forth in this chapter. Ice cream truck means any vehicle from which ice cream, frozen milk, frozen dairy or ice confection products are sold or offered for sale. (Ord. 1995-5 § 1)

5.48.020 Requirements.

Requirements and restrictions for vending from ice cream trucks in the city of Glendale are as follows:

A.    An ice cream vendor shall register annually with the office of the City Clerk, on forms to be provided for that purpose.

B.    A copy of the required license to vend from an ice cream truck as set forth in Section 5.48.030 of this chapter shall be provided to the city at the time of registration.

C.    Proof of liability insurance coverage in the amount approved by the City Manager, with the city of Glendale named as an additional insured.

D.    Ice cream trucks shall not:

1.    Stop within twenty (20) feet of an intersection or double park when attempting a sale or when making a sale;

2.    Sell or attempt to sell any item from an ice cream truck on any arterial street, collector street or laned highway;

3.    Allow music played to be louder than eighty (80) dB(A) and shall discontinue music when truck is stopped. (Ord. 1995-5 § 2)

5.48.030 License required.

It is unlawful for any person to offer for sale ice cream, frozen milk, frozen dairy or ice confection products on the streets, alleys or other public places in the city except as authorized by this chapter without a current license to vend from an ice cream truck issued by a city requiring said license in the Denver metropolitan area. The required license shall be prominently displayed and visible at all times by being attached to the vendor’s clothing or to a cord worn around the neck. (Ord. 1995-5 § 3)

5.48.040 Conditions of good standing.

To be in good standing, a person registered to vend from an ice cream truck shall abide by the following conditions:

A.    The person registered to vend from an ice cream truck shall comply with all applicable ordinances of the city of Glendale.

B.    No sale or offer of sale shall be made by any ice cream vendor between sunset and 10:00 a.m.

C.    No sale or offer for sale of ice cream, frozen milk, frozen dairy or ice confection products shall be made from a mobile unit unless each side of the vehicle is marked, in letters and numbers at least three (3) inches in height, with the name and address of the registered ice cream vendor or his or her principal. 5.48.050 Revocation.

A person registered with the city of Glendale to vend from an ice cream truck may have such privilege revoked for the following reasons:

A.    Violations of the provisions of this chapter;

B.    Suspension or revocation of the required license to vend from an ice cream truck;

C.    Cancellation of the required liability insurance policy if said cancellation is not remedied within ten (10) days after the date of cancellation. (Ord. 1995-5 § 5)

5.48.060 Exempt.

Chapter 8.24, Noise, of this code does not apply to ice cream vending trucks only. (Ord. 1995-5 § 6)
