8.20.010 Prohibited—Exceptions.

It is unlawful for any person who is the owner or of any vehicle, or owner of any property or who is in charge or control of any property, whether as owner, manager, tenant, occupant, lessee or otherwise, to permit or allow any junked, abandoned, or partially wrecked vehicle or parts thereof to remain on such property longer than fifteen (15) days, and such vehicle is declared to be a nuisance; provided, that this section shall not apply with regard to an antique vehicle; a vehicle or parts of a vehicle in an enclosed building; a vehicle on the premises of a licensed motor vehicle dealership or repair shop operated in a lawful place and manner, when necessary to the operation of such dealership or repair shop; or a vehicle in an appropriate storage place or depository maintained for impounded vehicles by the city. 8.20.020 Notice to abate—Failure to comply.

A.    If any junked, abandoned, or partially wrecked vehicle, or parts thereof has remained on any premises for more than fifteen (15) days, as determined by recorded observations or a signed complaint, the Police Department shall require, by written notice personally served or sent by certified mail, the owner or agent of the premises upon which such vehicle is situated, to remove the same within seven (7) days following receipt of such written notice.

B.    For the purpose of this section, the tenant, occupant or lessee shall be deemed agent of the owner of the premises.

C.    Upon the failure, neglect or refusal of any owner or agent of the owner so notified to properly remove such vehicle or parts thereof from the premises within the time limits set forth in this chapter, the Police Department is authorized and empowered to remove the same and dispose of such vehicle or parts thereof in the manner established by the ordinances of the city.

D.    A summons and complaint in the Municipal Court may be issued to any owner of a junked, abandoned, or partially wrecked vehicle if such owner can be located, or to any owner or agent of the owner of any premises upon which such vehicle is situated for the failure or refusal to remove such junked, abandoned or partially wrecked vehicle or parts thereof whenever the same is in violation of this chapter.
