6-2 International Residential Code

A.    Adoption

The International Residential Code, 2009 edition, including Appendix Chapters E, J, L, and O, as published by the International Code Council is hereby adopted by reference as the Residential Code of the City of Ouray, State of Colorado, for regulating and governing the construction, alteration, movement, enlargement, replacement, repair, equipment, location, removal and demolition of detached one- and two-family dwellings and multiple single-family dwellings (townhouses) not more than three stories in height with separate means of egress as herein provided; providing for the issuance of permit and collection of fees therefor; with the additions, insertions, deletions and changes, as described in this Chapter.

B.    Copy on File

A copy of the International Residential Code, 2009 edition, is on file at the office of the City of Ouray Building Inspector.

C.    Amendments

The International Residential Code, 2009 edition, is amended to read as follows:

1.    Section R101.1 Title is amended as follows:

These provisions shall be known as Residential Code for One- and Two-family Dwellings of the City of Ouray.

2.    Section 105.2. Work exempt from permit. Building, Subsection 1 is amended as follows:

One-story detached accessory structures used as tool and storage sheds, playhouses and similar uses, provided the floor area does not exceed 120 square feet.

3.    Section 108.5 Refunds is amended as follows:

Refunds shall be provided for in compliance with the refund policy of the City’s adopted building code.

4.    Section R109.1.5 Other inspections is amended by the addition of subsection R109.1.5.2 as follows:

R109.1.5.2. Insulation. Insulation is required to meet the standards of the International Energy Conservation Code, 2009 Edition.

5.    Section 112.1 General is amended as follows:

In order to hear and decide appeals of orders, decisions, or determinations made by the building official relative to the application and interpretation of this code, there shall be and is hereby created a board of appeals. The building official shall be an exofficio member of said board but shall have no vote on any matter before the board. The board of appeals shall consist of the members of City Council of the City of Ouray. The board may adopt rules of procedure for conducting its business, and shall render all decision and findings in writing to the appellant with a duplicate copy to the building official.

6.    Section 112.3 Qualifications is deleted in its entirety, along with all references thereto.

7.    Table R301.2(1) is amended as follows:

8.    Section 313.1 Townhouse automatic fire sprinkler systems is amended as follows:

Effective January 1, 2013, an automatic residential fire sprinkler system shall be installed in all two-family dwellings. As of January 1, 2012, automatic residential fire sprinkler systems may be required in any type of residence that, in the discretion of the building inspector, are located in such an area as to be difficult for emergency access by the Fire Department.

9.    Section 319.1 Address numbers is amended as follows:

Buildings shall have approved address numbers, building numbers or approved building identification placed in a position that is plainly legible and visible from the street or road fronting the property. These numbers shall contrast with their background. Address numbers shall be Arabic numbers or alphabetical letters. For new construction only, numbers shall be a minimum of 4 inches (102 mm) high with a minimum stroke width of 1/2 inch (12.7 mm). Where access is by means of a private road and the building address cannot be viewed from the public way, a monument, pole or other sign or means shall be used to identify the structure.

10.    Section G2406.2 Prohibited locations is amended by the deletion of subsections 3 and 4.

11.    Section G2425.8 Appliances not required to be vented is amended by the deletion of subsection 7, along with all references thereto.

12.    Section G2445.1 General is amended as follows:

Unvented room heaters are prohibited in all locations and throughout all occupancies.

13.    Section P2603.6.1 Sewer depth is amended as follows:

Private sewage disposal systems are not permitted within the City of Ouray.

D.    Penalty

The following penalty clause as contained in the International Residential Code, 2009 Edition, is hereby set forth in full and adopted:

Section R113.4 Violation Penalties. Any person who violates a provision of this code or fails to comply with any of the requirements thereof or who erects, constructs, alters or repairs a building or structure in violation of the approved construction document or directive of the building official or of a permit or certificate issued under the provision of this code, shall be subject to penalties as prescribed by law.
