ESTABLISHING ELECTION PRECINCTS

1.10.010 Boundaries of unincorporated areas and certain incorporated areas to be fixed by the Board of Supervisors.

Precincts established as provided by Iowa Code Section 49.4, shall be used for all elections, except where temporary merger or division of established precincts is specifically permitted by law for certain elections, and no political subdivision shall concurrently maintain different sets of precincts for use in different types of elections.

A. No precinct shall have a total population in excess of 3,500, as shown by the most recent federal decennial census.

B. Each precinct is contained wholly within an existing legislative district.

C. Precincts shall be composed of contiguous territory within a single county. The boundaries of all precincts shall follow the boundaries of areas for which official population figures are available from the most recent federal decennial census.

D. All election districts shall be drawn to standards of Iowa Code Chapter 49.

E. A precinct map shall be prepared for the new boundaries and is made a part of this chapter herewith. [Ord. 114 § 1, 2011; Ord. 61 § 1, 2001. Code 2009 § 1-6-2.]

1.10.020 Certification to Secretary of State.

County plans must be postmarked on or before Thursday, September 15, 2011, and submitted to the Secretary of State. The boundaries of all precincts in the unincorporated areas and certain incorporated areas of Black Hawk County shall be established and defined as set forth:

A. Barclay Township and Lester Township, including the incorporated City of Dunkerton precinct.

B. Bennington Township precinct.

C. Big Creek Township, including the incorporated City of La Porte City precinct.

D. Black Hawk Township, including the incorporated City of Hudson and Lincoln Township precinct.

E. Cedar and Orange townships precinct.

F. The incorporated Cedar Falls City, Ward 2, precinct 2 and Cedar Falls Township precinct.

G. Eagle Township precinct.

H. Elk Run Heights and Raymond cities precinct. In accordance with Iowa Code Section 49.4, this precinct will include both Elk Run Heights and Raymond cities. Iowa Code Section 49.11(3)(c) will permit the division of the two cities for city elections.

I. Mount Vernon Township precinct.

J. Poyner precinct 1 and East Waterloo Township precinct as follows: Poyner precinct 1 and East Waterloo Township precinct consist of the unincorporated portion of Poyner Township north of Indian Creek Road and Gilbertville Road and all of East Waterloo Township.

K. Poyner precinct 2/Gilbertville/Fox Township/Jesup precinct as follows: Poyner precinct 2/Gilbertville/Fox Township/Jesup precinct consists of the unincorporated portion of Poyner Township south of Indian Creek Road and Gilbertville Road, all of the incorporated City of Gilbertville, and Fox Township, including the portion of the incorporated City of Jesup within Black Hawk County.

L. Spring Creek Township precinct.

M. Union Township precinct.

1.10.030 Public hearings required.

Before the final adoption of the ordinance establishing the precincts, two public hearings must be held. These hearings must be advertised in advance, as required by the Open Meetings Law, Iowa Code Section 49.4. [Ord. 114 § 3, 2011; Ord. 61 § 3, 2001. Code 2009 § 1-6-4.]

1.10.040 Effective date.

New precinct boundaries become effective Sunday, January 15, 2012 (Iowa Code Section 49.7). Publication of the ordinance codified in this chapter will be made prior to January 15, 2012, and when approval of Black Hawk County’s reprecincting plan has been received by the Iowa Secretary of State. 1.10.050 Additional publication notice.

Iowa Code Section 49.11 requires that the revised boundaries of precincts be published three times, at least 30 days before the next general election. [Ord. 114 § 5, 2011; Ord. 61 § 5, 2001. Code 2009 § 1-6-6.]
