2-1-1 CREATION, MEMBERSHIP:

A.    Creation: There is hereby created a permanent committee for Garden City which shall be known as the parks and waterways committee, whose purpose it is to preserve the natural assets of the Boise River, provide recommendations to the city council regarding the development and use of public park property, and to serve as the Garden City tree committee.

B.    Membership: The parks and waterways committee shall consist of not less than five (5) and no more than seven (7) members, who shall be appointed by the mayor with the advice and consent of the city council. All members shall be residents of Garden City. The term of office for each committee member shall be three (3) years. No person shall serve more than two (2) consecutive full terms. 2-1-2 OFFICERS, ORGANIZATIONAL RULES AND BYLAWS:

Committee shall select from among its appointed members such officers as it deems prudent to conduct the affairs of the committee and, in addition, may select nonvoting, ex officio members to serve on or provide advice to the committee. The rules and bylaws of the parks and waterways committee shall be adopted and approved by resolution of the Garden City council and shall govern the organization and internal affairs of the committee in a manner consistent with this chapter. The rules and bylaws may be amended from time to time on the approval of the mayor and city council. (1988 Code)

2-1-3 RESIGNATIONS AND VACANCIES:

Should any member of the Garden City parks and waterways committee resign or should a vacancy occur, a replacement member shall be appointed in a manner consistent with this chapter to fill out the term of office for that originally provided for the member resigning or vacating. (1988 Code)

2-1-4 BUDGET AND COMPENSATION:

The parks and waterways committee shall have such funds available for such purposes as are approved by the city council in the city’s budget, and the committee shall make recommendations annually to the public works director for projects and activities to be included in annual budget requests to the city council. All members of the committee shall serve without compensation. However, actual and necessary expenses may be allowed with the prior approval of the mayor and city council. (1988 Code)

2-1-5 POWERS, DUTIES AND JURISDICTION:

A.    The parks and waterways committee shall act in an advisory capacity to the city council. The committee shall report its recommendations, together with minutes of its meetings to the Garden City council after each regular or special meeting of the committee.

B.    In furtherance of its purpose, the committee shall have the responsibility for reviewing all changes, development or construction of improvements that may occur within its jurisdiction along the Boise River, on city owned park lands and within street rights of way pursuant to the tree ordinance, and making recommendations with regard to such improvements to the city. The committee shall also have the responsibility of working with other governmental entities and agencies in connection with improvements to be made to the greenbelt.

C.    The committee shall also have the responsibility to preserve the natural environment of the Boise River, preserve wildlife habitats, encourage both public and private open space and recreational uses, develop and enhance the Boise River greenbelt, protect the water quality of the Boise River and its tributaries, protect and enhance the fishery of the Boise River and its tributaries, protect human life and health and minimize property damage from flooding, and to maintain public access to and along the Boise River.

D.    The committee shall have jurisdiction to make recommendations on all park property owned by the city and those street right of way areas included in the tree ordinance. (1988 Code)

2-1-6 SEVERABILITY:

If any one or more sections or subsections of this chapter are for any reason held to be invalid or unconstitutional, such shall not affect the validity of the remaining portions of this chapter and the same are and shall remain in full force and effect. (1988 Code)
