LOST OR ABANDONED PROPERTY

4-9-1 CUSTODY:

All lost or abandoned property found upon property belonging to the city shall be deposited with and transferred to the custodial possession of the police department. All other property, lost or abandoned, turned in to the police department shall become the property of the city until the true owner is ascertained and claims the property, or the procedure for disposal of such property set forth in this chapter has been followed. 4-9-2 DISPOSITION:

All lost or abandoned property coming into the possession of the Garden City police department shall be disposed of in accordance with the provisions of section 55-403, Idaho Code. (Ord. 469, 8-9-1983)

4-9-3 PUBLIC USE:

Any lost or abandoned property which has come into the possession of the police department and has been held for a minimum period of six (6) months, may be put to a public use rather than sold at a public auction. Prior to such public use, however, the city council must, by resolution, describe the property to be subject to public use and specifically authorize the utilization of such property for such public use. Notice of proposed action by the city council to appropriate abandoned property to public use must be published in a newspaper of general circulation in Ada County at least ten (10) days prior to any city council meeting where such a resolution is being considered for adoption. The notice shall specify that any persons or corporations claiming an interest in the property must be present to present their claims at the council meeting at which the resolution is being considered.
