7-2-1 BUILDING CODE:

A.    Code Adopted: All rules, regulations and ordinances of a general and permanent character relating and applying to and regulating the erection, construction, enlargement, alteration, repair, moving, removal, conversion, demolition, occupancy, equipment, use, height, area and maintenance of buildings or structures as said rules, regulations and ordinances are printed and contained in code form designated and entitled "International Building Code" (IBC), the "International Residential Code" (IRC), Parts I through IV and IX, and "International Existing Building Code" (IEBC) be and the same hereby are ratified and adopted as the building code of Garden City and as ratified and adopted shall be the rules and regulations and ordinances governing the erection, construction, enlargement, alteration, repair, moving, removal, conversion, demolition, occupancy, equipment, use, height, area and maintenance of buildings or structures within the city.

B.    Code On File: A copy of the building code shall be retained by the city and shall be filed in the office of the city clerk in accordance with Idaho Code section 50-901 for use and examination by the public. (Ord. 973-14, 12-8-2014; Ord. 995-18, 2-26-2018)

7-2-2 INTERNATIONAL BUILDING CODE AMENDMENTS:

The International Building Code, prepared by the International Code Council, Inc., as adopted by the state of Idaho or the Idaho Building Code Board, together with any amendments or revisions to the International Building Code made by the Idaho Building Code Board through the negotiated rulemaking process, is adopted with the following amendments:

A.    Section 101.1, Title

These regulations shall be known as the Building Code of Garden City, hereinafter referred to as "this code."

B.    Section 101.4.3, Applicable Plumbing Code

The provisions of the plumbing code as adopted by Garden City shall apply to the installation, alterations, repairs and replacement of plumbing systems, including equipment, appliances, fixtures, fittings and appurtenances, and where connected to a water or sewage system and all aspects of a medical gas system. The number of required plumbing fixtures shall be determined by using IBC Table 2902.1 and as per the International Plumbing Code as referenced in the table.

C.    Deleting Section 101.4.4, Property Maintenance Code

D.    Section 101.4.7, Abatement Of Dangerous Buildings Code

The provisions of the Abatement of Dangerous Building Code as adopted by Garden City shall provide a just, equitable and practicable method to abate buildings or structures which from any cause endanger the life, limb, health, morals, property, safety or welfare of the general public or their occupants.

E.    Section 101.4.8, Applicable Electrical Code

The provisions of the electrical code as adopted by Garden City shall apply to the installation of electrical systems, including alterations, repairs, replacement, equipment, appliances, fixtures, fittings and appurtenances thereto.

F.    Section 102.6, Existing Structures

The legal occupancy of any structure existing on the date of adoption of this code shall be permitted to continue without change, except as is specifically covered in this code, the International Fire Code, the International Existing Building Code, or as is deemed necessary by the building official for the general safety and welfare of the occupants and the public.

G.    Section 103, Department Of Building Safety

The Department of Building Safety Services shall be established as described in Garden City Code § 7-1-2.

H.    Section 105.1, Required Permits

Required Permit shall be as established in Garden City Code § 7-1-3.

I.    Section 105.2, Work Exempt From Permit

Exemptions from permit requirements of this code shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of this jurisdiction. Building permits shall not be required for the following:

Building:

1. One-story detached accessory structures used as tool and storage sheds, playhouses and similar uses, provided the floor area is not greater than 120 square feet (11 m2).

2. Fences not over 7 feet (2,134 mm) high.

3. Oil derricks.

4. Retaining walls that are not over 4 feet (1,219 mm) in height measured from the bottom of the footing to the top of the wall, unless supporting a surcharge or impounding Class I, II, or III-A liquids.

5. Water tanks supported directly on grade if the capacity is not greater than 5,000 gallons (18,925L) and the ratio of height to diameter or width is not greater than 2:1.

6. Sidewalks and driveways not more than 30 inches (762 mm) above adjacent grade, and not over any basement or story below and are not part of an accessible route.

7. Painting, papering, tiling, carpeting, cabinets, counter tops and similar finish work.

8. Temporary motion picture, television and theater stage sets and scenery.

9. Prefabricated swimming pools accessory to a Group R-3 occupancy, which are less than 24 inches (610 mm) deep, do not exceed 5,000 gallons (18,925L) and are installed entirely above ground.

10. Shade cloth structures constructed for nursery or agricultural purposes not including service systems.

11. Swings and other outdoor playground equipment.

12. Window awnings in Group R-3 and U occupancies, supported by an exterior wall, that do not project more than 54 inches (1,372 mm) from the exterior wall and do not require additional support.

13. Non fixed and movable fixtures, cases, counters and partitions not over 5 feet 9 inches (1,753 mm) in height and storage racks 8 feet or less in height.

14. Utility poles when supported on grade.

15. Un-manned public transit centers, 120 square feet or less and not exceeding 15 feet in height, open on at least one side for the entire length of the structure, only when located in rights-of-way and accompanying curbs, gutters, culverts, sidewalks, paved medians, bulkheads and retaining walls, or when located in public alleys.

16. Below grade, non-occupied vault utilized in the maintenance of a public or private entity, only when located in rights-of-way and accompanying curbs, gutters, culverts, sidewalks, paved medians, bulkheads and retaining walls, or when located in public alleys.

17. Wind turbines installed per manufacturer’s specifications.

J.    Section 105.2, Deleting Subsections On Electrical, Gas, Mechanical And Plumbing

K.    Section 105.2.1, Emergency Repairs

Where equipment replacements and repairs must be performed in an emergency situation, the permit application shall be submitted within the next working business day or as determined by the administrator of Building Safety Services or his or her designee.

L.    Section 105.2.2, Repairs

Application or notice to the City is not required for ordinary repairs to structures. Such repairs shall not include the cutting away of any wall, partition or portion thereof, the removal or cutting of any structural beam or load-bearing support, or the removal or change of any required means of egress, or rearrangement of parts of a structure affecting the egress requirements.

M.    Section 105.3, Application For Permits

To obtain a permit, the applicant shall first file an application on a form furnished by Garden City for that purpose. Such application shall:

1. Identify and describe the work to be covered by the permit for which application is made.

2. Describe the land on which the proposed work is to be done by legal description, parcel number, street address or similar description that will readily identify and definitely locate the proposed building or work.

3. Indicate the use and occupancy for which the proposed work is intended.

4. Be accompanied by construction documents and other information as required by an approved Garden City application form.

5. State the valuation of the proposed work.

6. Contain the applicant, or the applicant’s authorized agent’s, signature.

7. Give such other data and information as required by Garden City.

N.    Section 105.3.2, Time Limitation Of Application

The Time Limitation of Application shall be as described in Garden City Code § 7-1-6.

O.    Section 105.5, Permit Expiration

Permit Expiration shall be as established in Garden City Code § 7-1-6.

P.    Section 105.8, Permit Transfer

Permit Transfers shall be allowed as established in Garden City Code § 7-1-8.

Q.    Section 107.1 And The Exception, Submittal Documents

Construction documents, special inspection and structural observation programs, and other data as required by Garden City shall be submitted with each application for a permit.

These plans and specifications shall be prepared, signed and sealed by an architect licensed by the State of Idaho under Section 54-309, Idaho Code, as amended.

Exceptions: Nothing contained above shall be held or construed to have any application to or prevent or affect the following:

1. Groups B, F1, F2, M, S1 and S2 occupancies not exceeding two (2) stories and 6,000 square feet total area may be prepared, signed and sealed by a professional engineer licensed by the State of Idaho.

2. Buildings which are multiple living units not to exceed three (3) units.

3. Farm buildings, out buildings or auxiliary buildings in connection with residential or farm premises.

4. Groups R-3 and U occupancies not exceeding three (3) stories in height above grade.

5. Existing interior tenant improvements, where no change of use or occupancy is occurring, not exceeding a total of 1,500 square feet for the entire tenant space of existing A, B, E, F1, F2, M, S1, and S2 occupancies.

6. Interior nonbearing partitions not exceeding sixty (60) lineal feet.

7. Minor work at discretion of the building official.

8. For buildings or structures, not principally architectural, the design of which involves principally engineering considerations, the plans and specifications may be prepared, signed and sealed by a professional engineer licensed by the State of Idaho and qualified in the engineering specialty involved.

R.    Section 109, Fees

Fees are as established in Garden City Code § 7-1-4.

S.    Section 110.3.3, Lowest Floor Elevation

In flood hazard areas, upon placement of the lowest floor, including the basement, the elevation certification required in Section 1612.5 shall be submitted to the City prior to the request for a framing inspection.

T.    Section 111, Certificate Of Occupancy

Certificate of Occupancy shall be as prescribed in Garden City Code § 7-1-13.

U.    Section 112.1, Connection Of Service Utilities

A final inspection and approval is required upon completion and prior to occupancy and use of all buildings and structures for connection of service utilities. Connection to utilities may be permitted on a temporary basis if an active building permit has been issued. Lack of approval may result in the termination of utility services to said building or structure and prosecution under IBC Section 114.3.

V.    Section 112.4, Disconnect Utilities For Occupancy Violations

Disconnection of utilities for occupancy violations shall be as described in Garden City Code § 7-1-14.

W.    Section 113.1, Building Code Board And Section 113.4 Appeals To The Board

The Board of Appeals shall be as prescribed in Garden City Code § 7-1-11.

X.    Section 114, Violations

Violations shall be identified and enforced upon as described in Garden City Code § 7-1-14.

Y.    Section 202, Definition For Townhouse

TOWNHOUSE: A single-family dwelling unit constructed in a row of attached units separated by property lines and with open space on at least two sides.

Z.    Section 305.2.3, Twelve Or Fewer Children In A Dwelling Unit

A facility such as the above within a dwelling unit and having twelve or fewer children receiving such day care shall be classified as a Group R-3 occupancy or shall comply with the International Residential Code.

AA.    Section 308.6.4, Persons Receiving Care In A Dwelling Unit

308.6.4 Persons receiving care in a dwelling unit. A facility such as the above within a dwelling unit and having twelve or fewer children receiving day care or having five or fewer persons receiving custodial care shall be classified as a Group R-3 occupancy or shall comply with the International Residential Code.

BB.    Section 310.5, Residential Group R-3

310.5 Residential Group R-3. Residential occupancies where the occupants are primarily permanent in nature and not classified as Group R-1, R-2, R-4, E or I, including:

Buildings that do not contain more than two dwelling units

Boarding houses (nontransient) with 16 or fewer occupants

Boarding houses (transient) with 10 or fewer occupants

Care facilities that provide accommodations for five or fewer persons receiving care

Congregate living facilities (nontransient) with 16 or fewer occupants

Congregate living facilities (transient) with 10 or fewer occupants

Dwelling units providing day care for twelve or fewer children

CC.    Section 310.5.1, Care Facilities Within A Dwelling

310.5.1 Care facilities within a dwelling. Care facilities for twelve or fewer children receiving day care or for five or fewer persons receiving care that are within a single-family dwelling are permitted to comply with the International Residential Code.

DD.    Section 1605.2, Load Combinations Using Strength Design Or Load And Resistance Factor Design, Add Exception 3

Add Exception 3 to Section 1605.2 as follows:

3. In Equation 16-3, the snow load S shall be calculated using pm as defined in Section 1608.1. For other load combinations involving snow loads, S shall be calculated using flat roof snow load (pf) or sloped roof snow load (ps) as defined in ASCE 7.

EE.    Section 1605.3.1, Basic Load Combinations, Add Exception 6

Add Exception 6 to Section 1605.3.1 as follows:

6. In Equation 16-10, the snow load S shall be calculated using pm as defined in Section 1608.1. For other load combinations involving snow loads, S shall be calculated using flat roof snow load (pf) or sloped roof snow load (ps) as defined in ASCE 7.

FF.    Section 1608.1, Snow Loads

Design snow loads shall be determined in accordance with Chapter 7 of ASCE 7, but the design roof load, regardless of roof slope, shall not be less than a uniform snow load of pm = 25 psf. This minimum roof snow load is a separate load case. It need not be used in determining or in combination with drift, sliding, unbalanced, rain-on-snow surcharge, or partial loads. These loads shall be considered as required per ASCE 7 and IBC section 1608.2 as amended. See Exhibit A showing two examples of required load cases.

EXHIBIT A

GG.    Section 1608.2, Ground Snow Loads

The ground snow load shall be pg = 20psf.

HH.    Section 1809.5, Frost Protection

Item #1 of Section 1809.5 shall be amended as follows:

Extending below or equal to the frost line of 24 inches below finished grade.

II.    Table 2902.1, Footnote F

Drinking fountains are not required for an occupant load of thirty (30) or fewer.

JJ.    Table 2902.1, Footnote G

For business occupancies, excluding restaurants and mercantile occupancies with an occupant load of thirty (30) or fewer, service sinks shall not be required.

KK.    Section 3401.5, Alternative Compliance

Work performed in accordance with the International Existing Building Code (IEBC) shall be deemed to comply with the provisions of this chapter. Where life safety issues are not specifically addressed by the IEBC the provisions of the IBC shall apply at the discretion of the building official.

7-2-3 INTERNATIONAL RESIDENTIAL CODE AMENDMENTS:

The International Residential Code, Parts I through IV and IX, prepared by the International Code Council, Inc., as adopted by the state of Idaho or the Idaho Building Code Board, together with any amendments or revisions to the International Residential Code made by the Idaho Building Code Board through the negotiated rulemaking process, is adopted with the following amendments:

A.    Section R101.1, Title

These provisions shall be known as the Residential Code for One-and Two-Family Dwellings of Garden City, and shall be cited as such and will be referred to herein as "this code."

B.    Section R101.2, Scope

Exception number one to Section R101.2 is deleted.

Exception number two to Section R101.2 is repealed and replaced with one exception as follows:

Exception: Owner-occupied lodging houses with five or fewer guestrooms shall be permitted to be constructed in accordance with the International Residential Code for One- and Two-family Dwellings.

C.    Section R102.7, Existing Structures

The legal occupancy of any structure existing on the date of adoption of this code shall be permitted to continue without change, except as is specifically covered in this code, the International Fire Code, or as is deemed necessary by the Building Official for the general safety and welfare of the occupants and the public.

D.    Section R103, Division Of Building Safety

Building Safety Services are as established in Garden City Code § 7-1-2.

E.    Section R104.10.1, Areas Prone To Flooding

The Building Official shall not grant modifications to any provision related to areas prone to flooding established by Table R301.2(1) without the review and express written approval by the Garden City Floodplain Administrator.

F.    Section R105.2, Work Exempt From Permit

Exemption from the permit requirements of this code shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of this jurisdiction. Permits shall not be required for the following:

Building:

1. One-story detached accessory structures provided the floor area does not exceed 200 square feet (18.58 m2).

2. Fences not over 7 feet (2,134 mm) high.

3. Retaining walls that are not over 4 feet (1,219 mm) in height measured from the bottom of the footing to the top of the wall, unless supporting a surcharge.

4. Water tanks supported directly upon grade if the capacity does not exceed 5,000 gallons (18,927 L) and the ratio of height to diameter or width does not exceed 2 to 1.

5. Sidewalks and driveways not more than 30 inches (762 mm) above adjacent grade and not over any basement or story below.

6. Painting, papering, tiling, carpeting, cabinets, counter tops and similar finish work.

7. Prefabricated swimming pools that are not greater than four (4) feet (1,219 mm) deep.

8. Swings and other playground equipment accessory to a one- or two-family dwelling.

9. Window awnings supported by an exterior wall which do not project more than 54 inches (1,372 mm) from the exterior wall and do not require additional support.

10. Work with a total value of $500.00 or less.

11. Flag poles and wind turbines installed per manufacturer’s specifications.

12. Decks that are not more than 12 inches above grade at any point and do not serve the exit door required by Section R311.4.

G.    Section R105.2.1, Emergency Repairs

Where equipment replacements and repairs must be performed in an emergency situation, the permit application shall be submitted within the next working business day or as determined by the administrator of Building Safety Services or his or her designee.

H.    Section R105.2.2, Repairs

Application or notice to the City is not required for ordinary repairs to structures, replacement of lamps or the connection of approved portable electrical equipment to approved permanently installed receptacles. Such repairs shall not include the cutting away of any wall, partition or portion thereof, the removal or cutting of any structural beam or load bearing support, or the removal or change of any required means of egress, or rearrangement of parts of a structure affecting the egress requirements; nor shall ordinary repairs include addition to, alter of, replacement or relocation of any gas piping, combustion vent, electric wiring or mechanical or other work affecting public health or general safety.

I.    Section R105.3.1.1, Determination Of Substantially Improved Or Substantially Damaged Existing Buildings In Flood Hazard Areas

For applications for reconstruction, rehabilitation, addition, or other improvement of existing buildings or structures located in an area prone to flooding as established by Table R301.2(1), the Garden City Floodplain Administrator shall examine or cause to be examined the construction documents for the proposed work. For buildings that have sustained damage of any origin, the value of the proposed work shall include the cost to repair the building or structure to its pre-damage condition. All substantially improved or reconstruction of existing structures shall be made in accordance with the Garden City Floodplain Ordinance.

J.    Section R105.3.2, Time Limitation Of Application

The Time Limitation of Application shall be as described in Garden City Code § 7-1-6.

K.    Section R105.5, Permit Expiration

Permit Expiration shall be as described in Garden City Code § 7-1-6.

L.    Section R105.10, Permit Transfer

Permit Transfers shall be allowed as established in Garden City Code § 7-1-8.

M.    Section R106.1, Submittal Documents

Construction plans, special inspection and structural observation programs, and other pertinent data shall be submitted with each application for a permit as required by the permit or as requested for adequate review. Plans for all townhouse construction with four (4) or more units attached shall be prepared, signed and sealed by an architect licensed by the State of Idaho under Section 54-309, Idaho Code, as amended.

N.    Section R107.3, Temporary Power

The Building Official is authorized to give permission to temporarily supply and use power in part of an electric installation before such installation has been fully completed and the final certificate of completion has been issued. The part covered by the temporary certificate shall comply with the requirements specified for temporary lighting, heat or power in the electrical code as adopted by Garden City.

O.    Section R108, Fee

Fees are as established in Garden City Code § 7-1-4.

P.    Section 109.1.3, Floodplain Inspections

For construction in areas prone to flooding as established by Table R301.2(1), upon placement of the lowest floor, including basement, the building official shall require submission of documentation, prepared and sealed by a registered design professional, of the elevation of the lowest floor, including basement, required in Section R322 prior to the request for a framing inspection.

Q.    Section R109.4, Approval Required

Work shall not be done beyond the point indicated in each successive inspection without first obtaining the approval of the Building Official. The Building Official, upon notification, shall make the requested inspections and shall either indicate the portion of the construction that is satisfactory as completed, or shall notify the permit holder or an agent of the permit holder wherein the same fails to comply with this code. Any portions that do not comply shall be corrected and such portion shall not be covered or concealed until authorized by the Building Official. A final inspection and approval is required upon completion and prior to occupancy and use of all buildings and structures.

R.    Section R110, Certificate Of Occupancy

Certificate of Occupancy shall be as prescribed in Garden City Code § 7-1-13.

S.    Section R111.1, Connection Of Service Utilities

A final inspection and approval is required upon completion and prior to occupancy and use of all buildings and structures for connection of service utilities. Lack of approval may result in the termination of utility services to said building or structure and prosecution under the penalty provisions of this code.

T.    Section R112, Board Of Appeals

The Board of Appeals shall be as prescribed in Garden City Code § 7-1-11.

U.    Section R113, Violations

Violations shall be identified and enforced upon as described in Garden City Code § 7-1-14.

V.    Section R114, Stop Work Order

R114.1 Authority. Whenever an agent of the City finds any work regulated by this code being performed in a manner contrary to the provisions of this code or in a dangerous or unsafe manner, the administrator of Building Safety Services or his or her designee is authorized to issue a stop work order.

R114.2 Issuance. The stop work order shall be in writing and shall be given to the owner of the property involved, or to the owner’s agent, or to the person doing the work. Upon issuance of a stop work order, the cited work shall immediately cease. The stop work order shall state the reason for the order, and the conditions under which the cited work will be permitted to resume.

R114.3 Unlawful continuance. Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be subject to penalties as prescribed by law.

W.    Section R202, Definition For Townhouse

Z.    Section R302.2, Townhouse Exception

A common one-hour or two-hour fire resistance rated wall assembly tested in accordance with the ASTM E 119 or UL 263 is permitted for townhouses if such walls do not contain plumbing or mechanical equipment, ducts or vents in the cavity of the common wall. The wall shall be rated for fire exposure from both sides and shall extend to and be tight against the exterior walls and the underside of the roof sheathing. Penetrations of electrical outlet boxes shall be in accordance with section R302.4.

AA.    Section R303.4, Mechanical Ventilation

Repeal section R303.4 and replace with the following:

R303.4 Mechanical ventilation. Dwelling units shall be provided with whole-house mechanical ventilation in accordance with Section M1507.3.

Exception: Where the air infiltration rate of a dwelling unit is equal to 5 air changes per hour or greater when tested with a blower door at a pressure of 0.2 inch w.c. (50 pa) in accordance with Section N1102.4.1.2.

BB.    Section R304.1, Minimum Area

Every dwelling unit shall have at least one room that shall have not less than 120 square feet of habitable gross floor area not including the area dedicated to a kitchen and a closet exclusive to this room.

CC.    SECTION 306.1, Toilet Facilities

Every dwelling unit shall be provided with a water closet, lavatory exclusive to the toilet facilities, and a bathtub or shower.

DD.    Section 306.2, Kitchen

Every dwelling unit shall be provided with a kitchen area and every kitchen shall be provided with:

a. a sink exclusive to the kitchen;

b. refrigerator;

c. stove or oven;

d. A cumulative ten lineal foot (10') food preparation area not less than twelve inches (12") in depth; and

e. Storage of not less than a cumulative 1,080 square inches exclusive to the kitchen.

EE.    Section R313.1, Townhouse Automatic Fire Sprinkler Systems Exception

Automatic residential fire sprinkler systems shall not be required in townhouses where a two-hour fire-resistance rated wall is installed between dwelling units or when additions or alterations are made to existing townhouses that do not have an automatic residential fire sprinkler system installed.

FF.    Deleting Section 313.2

GG.    Section R315.2, Carbon Monoxide Alarms Where Required In Existing Dwellings

R315.3 Where required in existing dwellings.

Where work requiring a permit occurs in existing dwellings that have attached garages or in existing dwellings within which fuel-fired appliances exist, carbon monoxide alarms shall be provided in accordance with Section R315.1.

Exceptions:

1. Work involving the exterior surfaces of dwellings, such as, but not limited to, replacement of roofing or siding, or the addition or replacement of windows or doors, or the addition of a porch or deck, or electrical permits, are exempt from the requirements of this section.

2. Installation, alteration or repairs of noncombustion plumbing or mechanical systems are exempt from the requirements of this section.

Testing shall occur after rough in and after installation of penetrations of the building envelope, including penetrations for utilities, plumbing, electrical, ventilation and combustion appliances.

During testing:

1. Exterior windows and doors, fireplace and stove doors shall be closed, but not sealed;

2. Dampers shall be closed, but not sealed; including exhaust, intake, makeup air, back draft, and flue dampers;

VV.    Section N1104.1, Lighting Equipment (Mandatory)

N1104.1 Lighting equipment (Mandatory). A minimum of 50 percent of the lamps in permanently installed lighting fixtures shall be high-efficacy lamps or a minimum of 50 percent of the permanently installed lighting fixtures shall contain only high efficacy lamps.

Exception: Low-voltage lighting shall not be required to utilize high-efficacy lamps.

7-2-4 MINIMUM STANDARDS FOR MODULAR AND MANUFACTURED HOME STRUCTURES:

A.    All new manufactured (modular) (non-HUD) structures must bear the insignia from the State of Idaho Division of Building Safety and shall only be allowed to be occupied for the use listing on the insignia.

B.    To gain approval for an existing (modular) (non-HUD) structure, the structure must undergo procedures as required by the State of Idaho Division of Building Safety and must bear the insignia prior to being allowed to be occupied for the use listed on the insignia, except for pre-HUD mobile homes constructed prior to June 15, 1976, which shall comply with the Mobile Home Rehabilitation Act, Idaho Code title 44, chapter 25, prior to occupancy.

C.    The State of Idaho Division of Building Safety manufactured home installation standard, as defined in Idaho Code title 44, chapter 22, shall be the minimum standard for the installation of manufactured homes in the city of Garden City. (Ord. 973-14, 12-8-2014)

7-2-5 AUTO EMISSION TESTING STRUCTURES:

A.    Purpose And Policy: Pursuant to state and federal law, motor vehicles registered in Ada County must be tested annually and must pass an air quality emissions test. Until recently, the emission tests have been administered by equipment housed in vans parked in parking lots on heavily traveled streets or highways. The vans have now transitioned into structures similar in construction to equipment sheds or outbuildings. The sheds are not built up to the standards of the building codes adopted by the city. The city recognizes that it would be cost prohibitive to build these temporary structures up to code standards and the city does not desire to have these structures built to be permanent. Recognizing the mandated program and the requirement that the testing facilities be located in Garden City, the city deems it in the best interest of the city to grant this limited exception to the Garden City Code and exempt auto emission testing facilities from the Garden City building code.

B.    Exemptions And Permits:

1. With the exception of the section of the International Building Code regulating temporary structures, temporary structures located and used for the purpose of performing air quality auto emission tests shall be exempt from the building regulations contained in this chapter. The time limitations set forth shall also not apply to these structures. All other building regulations contained in this title shall be in full force and effect if applicable.

2. The owners of such facilities shall be required to obtain a certificate of inspection and business compliance from the city in order to use the structure for emission testing. This shall include the existing facilities operating in the city as of the date of passage of the ordinance codified in this section.

C.    Safety And Operational Standards: The city, by resolution, will establish safety and operational standards for the auto emission testing facilities. Failure for a facility to maintain these standards shall be grounds for revocation of the operator’s permit.

D.    Temporary Nature Of Facilities And Scope Of Operation:

1. The structures are intended to be temporary in nature and not permanently affixed to the ground by a permanent foundation. If the air quality testing program is terminated in Ada County or changed in a nature that eliminates the need for the facilities, the facilities shall be removed within thirty (30) days of the termination or change.

2. The business conducted at these facilities shall be related to the service of automobiles as required by law and no other business shall be conducted by the operators of the facilities.

3. The placement of banners, balloons or the like on or near the structure is prohibited.

E.    New Facilities: The establishment of a new testing facility after the passage of the ordinance codified in this section must be approved by the Garden City council upon procedures established by the city’s development services department. (Ord. 973-14, 12-8-2014; Ord. 995-18, 2-26-2018)
