2-04-010 Appointment powers and duties.

The mayor shall appoint all officers of the city whose appointment is not otherwise provided by the laws of this state or the provisions of this code. Whenever a vacancy shall occur in any office which by law he is empowered to fill, the mayor shall, within thirty (30) days after the occurrence of such vacancy, communicate to the city council the name of his appointee to such office. 2-04-020 Supervisory authority—Administrative officer’s appointment, powers and duties.

A.    The mayor shall supervise the conduct of all the officers of the city, and as to all who are exempt from the provisions of the Civil Service Act, he shall examine the grounds of all reasonable complaints made against any of them and cause their violation of duty and other offenses, if any, to be promptly punished.

B.    The mayor shall appoint an officer to be known as the mayor’s administrative officer who shall serve at the pleasure of the mayor. Such officer shall have had at least three years experience in responsible government or private administrative positions as shall qualify him for the duties Of this office. The mayor may propose a professional services contract to the city council on behalf of the administrative officer, which contract may provide for particular terms of compensation, duties and length of service.

C.    The mayor’s administrative officer, subject to the direction and control of the mayor, shall supervise the administrative management of all city departments, boards, commissions and other city agencies established by this code and the laws of this state.

D.    In addition to such supervisory power, the mayor’s administrative officer may, in respect to any or all agencies under his supervision, establish reporting procedures, require the submission of progress reports, provide for the coordination of the activities of such agencies, and shall perform such other administrative and executive functions as may be delegated by the mayor. He shall make periodic reports with such recommendations as he deems appropriate to the mayor concerning the administrative management of all departments, boards, commissions and agencies of the city. 2-04-030 Ordinance enforcement authority.

The mayor, in addition to the duties, powers and functions vested in him by statute as the chief executive officer of the city and those specifically vested in him by the provisions of this code, shall have authority to act, or to designate the officer who shall act, in the enforcement of any ordinance of the city in all cases where an ordinance fails to specify the officer who shall be charged with the duty of enforcement. 2-04-040 Signature on documents.

The mayor’s signature shall appear on all licenses and permits granted by the authority of the city except as otherwise provided by law or provision of this code. In all cases where this code requires that the signature of the mayor shall be attached to any license, permit, contract, local improvement bond or other written instrument, and in all cases where said provisions require the mayor’s approval in writing or endorsement in writing, the mayor may, in his discretion, affix his signature or cause his signature to be affixed in such manner as may be authorized by law. 2-04-050 Mayor’s secretary—Appointment, powers and duties.

The mayor may appoint a secretary, whose duty it shall be to preserve and keep in the mayor’s office books and papers which are customarily filed, or are required by law to be filed, therein, to deliver to the city council and to the respective departments of the city all messages from the mayor in writing, to attend the mayor’s office during the usual office hours, and to perform such other duties as may be required by the mayor. 2-04-060 Contracts for release of claims.

Whenever, in the judgment of the mayor, the interests of the city will be safeguarded and protected by the making of a release to the city against claims for future damage to private property arising out of or resulting from the carrying out of any ordinance of the city providing for a local or general improvement or a public work, where such release can be obtained upon the payment by the city of a consideration of one dollar ($1.00), the mayor is authorized and =powered to enter into a contract of release on behalf of the city with the owner or owners of such private property and to pay to such owner or owners the sum of one dollar ($1.00) as a consideration for the release to the city of claims for future damages which may arise out of or result from the carrying out of such ordinances. The contract of release shall contain a proper legal description of such owner or owners as to which said release is to be effective and the said release, on being executed, shall be recorded in the office of the recorder of deeds of the county. 2-04-070 Coordinator of emergency activities.

The mayor shall be ex officio coordinator of activities in cases of emergency resulting from any explosion, fire, flood, riot, storm or other cause requiring concerted measures for the maintenance of public peace and order, the preservation of life and property and the relief of suffering, or for any of these purposes. He shall formulate, and, as occasion therefor arises, he shall execute plans for the prevention of such emergencies so far as possible and for meeting them effectively when they arise. Obedience to his orders in executing such plans and in meeting such emergencies is obligatory upon all departments and heads of departments and upon all other officers and employees of the city. The fire marshal shall be deputy coordinator of such activities under the supervision of the mayor as coordinator. In the absence or inability to act of the fire marshal, his power and responsibilities shall be vested in an acting deputy coordinator appointed by the fire marshal. (Ord. 2910 § 1 (part), 1995)

2-04-080 Freedom of information officer.

The mayor may designate, in writing, a person to hear appeals and make determinations on his behalf as the head of a public body with regard to the availability of records under the Freedom of Information Act. Persons requesting records from the city under the Act who receive a denial of their request shall be advised of the person to whom appeals of such denials may be made. (Ord. 2910 § 1 (part), 1995)
