5-44-010 License—Application.

Each application for a license to conduct a business connected with the storage, handling, sale or preparation of food or drink intended for human consumption shall be in writing and shall be referred to the health officer, who shall make or cause to be made an investigation of the premises to be used, and report his findings thereon, recommending or advising against the issuance of a license. 5-44-020 Revocation of license.

Any food dealer’s license may be revoked by the health officer for repeated violations of the provisions of this code, or for any violations of any other provisions relating to the conduct of the business, the condition of the premises or the licensee. (Prior code § 5-37-2)

5-44-030 Unwholesome food.

A.    No person shall sell, offer for sale, or keep for the purpose of selling or offering for sale any food of any kind intended for human consumption which is spoiled or tainted or is unwholesome and unfit for human consumption for any reason.

B.    All tainted or unwholesome food intended for human consumption may be condemned by the health officer and shall thereupon be seized and destroyed by him or any police officer. (Prior code § 5-37-3)

5-44-040 Adulteration.

It is unlawful to sell, offer for sale, or keep for such purpose, any food or drink intended for human consumption which has been adulterated by any material harmful in any way, or which does not comply with the state statutes governing the same. (Prior code § 5-37-4)

5-44-050 Sanitary regulations.

A.    Premises used for the sale or storage of food intended for human consumption must be kept in a clean and sanitary condition. It is unlawful to permit any accumulation of refuse or waste of any kind thereon for more than twenty-four (24) hours and it is unlawful to permit any decaying animal or plant matter to remain on such premises.

B.    No unwrapped food shall be displayed or stored in any food dealer’s establishment unless the same is effectually screened, protected against insects and rodents, and otherwise protected from outside contamination, and no food shall be kept in open shelves or display cases not exposed less than eighteen (18) inches above the floor.

C.    No person shall be allowed to sleep in any room used to store or keep food intended for sale for human consumption. (Prior code § 5-37-5)

5-44-060 Flies and vermin.

Premises used for the storage of food intended for human consumption shall be kept free from flies and rodents and vermin of all kinds. (Prior code § 5-37-6)

5-44-070 Employees.

A.    All persons engaged in handling or coming in contact with food intended for human consumption shall keep themselves clean, both as to person and clothing; no person afflicted with or a carrier of any contagious, infectious or venereal disease shall engage in the conduct of such business or be employed therein.

B.    The health officer may require any person engaged in handling or coming in contact with foods to submit to an examination by the health officer or produce a certificate from a reputable physician showing that the provisions of this section are being complied with. (Prior code § 5-37-7)

5-44-080 Definitions.

The term “food” as used in this chapter shall be construed to include beverages. (Prior code § 5-37-8)

5-44-090 Inspections.

The health officer shall make such inspections and recommendations as are necessary to carry out the provisions of these regulations. (Prior code § 5-37-9)
