9-16-010 Curfew established.

It is unlawful for any male person under the age of seventeen (17) years and any female person under the age of seventeen (17) years to be in any street or alley or other public place between the hours of eleven-thirty p.m. Friday and six a.m. Saturday or between the hours of eleven-thirty p.m. Saturday and six a.m. Sunday or between the hours of ten-thirty p.m. and six a.m. on any other day of the week unless accompanied by or in the charge of a parent, guardian, or other proper companion of the age of twenty-one (21) years or more, or unless engaged in some occupation or business in which said child may lawfully engage under the statutes of this state. 9-16-020 Parent’s responsibility.

It is unlawful for any person having the legal care and custody of a child under the age of seventeen (17) years to allow or permit said child to go or to be in any public place, street, or alley in the nighttime, as restricted in the Section 9-16-010 except in the case of necessity. 9-16-030 Police to take custody.

A.    Every member of the police force while on duty is authorized to detain any minor wilfully violating the provisions of Section 9-16-010 of this code until the parent or guardian of the child shall take him into custody; but such officer shall immediately upon taking custody of the child, communicate with the parent or guardian.

B.    Such police officer shall report in writing the violation to his superior officer and to the juvenile officer and shall cause a written notice to be served upon the parent, guardian or person in charge of such child, setting forth the manner in which the child has been in violation, at the time said parent, guardian or person in charge of such child shall call for and take said child into his custody.

C.    Any parent, guardian or person in charge of such child who shall knowingly permit said child to violate the provisions of this chapter after receiving notice of the first violation shall be deemed guilty of a misdemeanor. (Prior code § 8-9-3)
