10-48-010 Mass transportation vehicles using mass transportation lanes regulated.

When mass transportation lanes are designated and appropriately indicated by signs and markings, it is unlawful for the driver of any mass transportation vehicle to use any other portion of the roadway. (Ord. 1668 § 9.2, 1964)

10-48-020 Mass transportation vehicle position in roadway on boulevards.

Position in roadway of mass transportation vehicles on boulevards shall be as follows:

The operator of a mass transportation vehicle shall operate as close to the right-hand side of the roadway as conditions of traffic permit. (Ord. 1668 § 9.3, 1964)

10-48-030 Forming funeral processions on boulevards.

No funeral procession shall form on a boulevard except if the place where the funeral service is performed abuts upon a boulevard and does not have an entrance abutting a city street. (Ord. 1668 § 9.4, 1964)

10-48-040 Drivers in a funeral procession.

Each driver in a funeral procession shall drive as near to the right-hand edge of the roadway as practicable and shall follow the vehicle ahead as close as is practicable and safe. (Ord. 1668 § 9.5, 1964)

10-48-050 Operation of certain vehicles restricted on boulevards.

It is unlawful to operate any vehicle upon any boulevard (a) when such vehicle is used for carrying freight or other goods and merchandise for commercial purposes, (b) when such vehicle is designed primarily for carrying freight or other goods and merchandise on the outside of said vehicle, except at street intersections for the purpose of crossing a boulevard; provided, however, that vehicles carrying freight or other goods and merchandise from or to any building or premises abutting any boulevard where it is impossible from the location of the building or the kind or character of the freight or other goods and merchandise to be received or delivered, to receive or deliver the freight or other goods and merchandise from an alley or a side street or a street other than said boulevard, shall be permitted to enter such boulevard at the cross street nearest said building or premises and receive or deliver such freight or other goods and merchandise, but shall not thereafter proceed further on such boulevard than the nearest cross street. Operators of emergency vehicles and such vehicles excepted by permits issued by the police chief are exempt from the provisions of this section. (Ord. 1668 § 9.6, 1964)

10-48-060 Stopping, standing and parking of buses and taxicabs regulated.

A.    The driver of a bus shall not stand or park such vehicle upon any street at any place other than at a designated bus stand or bus terminal.

B.    The driver of a bus shall not stop such vehicle upon any street at any place for the purpose of loading or unloading passengers other than at a designated bus stop, bus stand, passenger loading zone or bus terminal except in case of an emergency.

C.    The driver of a bus shall enter a bus stop or passenger loading zone on a public street in such a manner that the bus, when stopped to load or unload passengers, shall be in a position with the right front wheel of such bus not further than eighteen (18) inches from the curb and the bus approximately parallel to the curb so as not to unduly impede the movement of other vehicular traffic.

D.    The driver of any taxicab shall not stop, stand or park such vehicle upon any business street, or in any block of any other street where a taxicab is already parked, at any place other than in a taxicab stand, except for the expeditious loading or unloading of passengers or when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic sign or signal. 10-48-065 Unlawful operation of buses.

A.    As used in this section, the following terms are defined as follows:

“Bus” means any type of commercial motor vehicle with a weight of at least thirty-six thousand (36,000) pounds, that is designed to carry, or is actually carrying, more than ten (10) individuals and operating as a common carrier.

“Regularly scheduled service” means bus service that operates trips involving passengers disembarking in the city on a predictable and recurring basis, following a schedule that is published in advance and available to the general public, and provides service in exchange for paying a fare.

“Unscheduled bus stop” means the unloading or disembarking of passengers from a bus subject to the requirements of Chapter 9-54 that is not operating pursuant to and in accordance with an application approved in accordance with that chapter.

B.    Prohibited Conduct.

1.    Unscheduled Bus Stops. No person, including, but not limited to, the owner, operator, or driver of any bus shall make an unscheduled bus stop in the city. This does not apply to motor vehicles which are not subject to Chapter 9-54.

2.    Operation of a Bus Without a City Franchise. Except as otherwise provided by law, it shall be unlawful for any person to operate a bus on any street, place or public highway in the city without first having obtained a specific grant of authority to do so from city council in the form of an ordinance designating the routes, terms, and conditions under which such bus may be operated, and regulating such other matters pertaining to the bus as is within the scope of powers granted to the city.

3.    Exemption. Nothing in this section will apply to any transportation for hire service which:

a.    Is operated by the federal government or any department or agency thereof;

b.    Is for the transportation of students for school purposes;

c.    Is operated primarily on an on-demand, door-to-door basis for the use of disabled passengers; or

d.    Under the Constitutions of the United States or state of Illinois, may not be made the subject of this regulation by the city.

C.    Penalty. Any person found guilty of violating, disobeying, omitting, neglecting, or refusing to comply with, or resisting or opposing the enforcement of any of the provisions of this section, upon conviction thereof, shall be punishable by a fine of seven hundred fifty dollars ($750.00) for each offense. The operation of each bus contrary to the provisions of this section shall be considered a separate and distinct offense for each day that the same is so operated.

D.    Impoundment. Whenever a police officer has probable cause to believe that any bus is being used in the commission or furtherance of a violation of this section, the police officer shall provide for the seizure and impoundment of such bus in the manner set forth in Chapter 9-52. 10-48-070 Cruising of public passenger vehicles.

No operator of a public passenger vehicle shall solicit business in such manner as to interfere with the lawful movement of traffic. (Ord. 1668 § 9-8, 1964)

10-48-080 Pushcarts—Animals.

Every person propelling any pushcart or riding an animal upon a roadway, and every person driving any animal-drawn vehicle, shall be subject to the provisions of this title applicable to the driver of any vehicle, except those provisions of this title which by their very nature can have no application. (Ord. 1668 § 9-10, 1964)

10-48-090 Pushcarts on boulevards.

No person shall operate any pushcart upon any boulevard. (Ord. 1668 § 9-11, 1964)

10-48-100 Coasters, roller skates and similar devices.

No person upon roller skates, or riding in or by means of any coaster, toy vehicle, or similar device, shall go upon any roadway except while crossing a street on a crosswalk and when so crossing such person shall be granted all the rights and shall be subject to all the duties applicable to pedestrians. This section shall not apply upon any street while set aside as a play street as authorized by ordinance of this city. (Ord. 1668 § 9-12, 1964)
