12-20-010 Distribution unlawful.

It is unlawful for any person to cause to be distributed any commercial handbill, pamphlet, circular, catalogue, letter, sample or any newspaper not regularly published except as hereinafter provided, without first having secured a license or permit so to distribute. 12-20-020 Application for license.

Each and every person desiring to cause to be distributed any commercial handbill, pamphlet, circular, catalogue, letter, sample or newspaper, not regularly published, shall make application in writing to the clerk for a permit or license, which application shall clearly set forth the nature of the commercial handbill, pamphlet, circular, catalogue, letter, or newspaper it is proposed to distribute, and the object thereof, to be accompanied with the annual registration fee as provided in this code. The clerk shall transmit the application to the mayor, and if approved by him, an annual permit or license, signed by the mayor and clerk, shall be issued to the applicant. (Ord. 2910 § 5 (Par. 12-20-030 Council action.

The issuance or the refusal to issue any permit or license shall be subject to review by the council, and the council may at any time, in its discretion, revoke any permit or license granted hereunder. (Prior code § 8-7-3)

12-20-040 License fee.

The clerk shall collect from each applicant in advance an annual registration fee (which shall not be prorated) in the sum of five dollars ($5.00) and in addition thereto each applicant shall pay to the clerk the sum of two dollars ($2.00) in advance for each distribution made and it is unlawful to distribute any of the matters mentioned in Section 12-20010 without first complying with this section. 12-20-050 U.S. mail.

Nothing contained in this chapter shall be construed so as to apply to distribution by United States mail. (Prior code § 8-7-6)

12-20-060 Light posts.

No person shall attach any papers, posters, signs, advertisements or other such objects of any type, whether commercial or noncommercial, either permanently or temporarily to any street light post. (Ord. 2910 § 5 (Par. F (part)), 1995: Ord. 2216 (part), 1980: prior code § 8-7-8)

12-20-070 Violation—Penalty.

Any person, firm or corporation violating any of the provisions of this chapter shall be fined no less than ten dollars ($10.00) nor more than fifty dollars ($50.00) for each offense and each day during or on which a violation occurs or continues shall constitute a separate and distinct offense.
