Article I. General Provisions

16-72-010 Purpose.

The purpose for establishing off-street parking and loading requirements is to alleviate or prevent traffic congestion in the streets of Harvey. The intent of this regulation is to establish minimum requirements for off-street parking, loading and unloading of motor vehicles in accordance with this chapter, to encourage the orderly development, design and maintenance of parking facilities so as to protect adjacent property and promote the health, safety and welfare of the community; to provide assistance to those private establishments which are willing to develop their own parking areas. Any parking space, lot or structure that does not comply with this chapter will be prohibited. (Ord. 2286 § 23.0, 1982)

16-72-020 General regulations.

A.    All structures erected after the effective date of this chapter shall provide off-street parking and loading facilities as required in this chapter.

B.    When the intensity of use of any structure or premises shall be increased through the addition of dwelling units, floor area, beds, seating capacity, employees or other units of measurement, parking and loading facilities as required in this chapter shall be provided for such increase in intensity of use.

C.    Whenever the existing use of a premises or structure shall be changed or converted to a new use permitted by this chapter, parking and loading facilities as required herein shall be provided as required for such new use.

D.    Existing off-street parking or loading facilities shall not be reduced below the number or size required by this chapter.

E.    Parking or loading facilities accessory to a nonconforming use that is damaged or partially destroyed not beyond fifty (50) percent, shall be restored to the number and size maintained at the time of such damage or to the amount required by this chapter.

F.    Two or more buildings or uses may collectively provide off-street parking, in which case the required number of parking spaces shall not be less than the sum of the requirement for the several individual uses computed separately.

G.    Every company vehicle normally stored at a business site shall be provided with off-street parking spaces in an area reserved for this use.

H.    Overnight parking of commercial vehicles in residential districts shall be prohibited, except that one such vehicle of one ton or less capacity may be parked on any improved zoning lot by a resident of the property.

I.    In commercial and manufacturing districts, parking facilities may be provided on a separate zoning lot not more than one thousand (1,000) feet from the premises served, provided the separate parking facility is located in the same district or a less restrictive district.

J.    When requited off-street parking facilities are provided elsewhere than on premises served, a deed, long-term lease or notarized written agreement is required by the planning department as proof of compliance with the off-street parking requirements.

K.    Any business that located in downtown Harvey may be applicable for a thirty (30) percent deduction in required off-street parking if the plan commission and city council considers the new establishment beneficial to the overall development of the downtown business district; examples: restaurants, offices, departmental stores, hardware, hobby, book, jewelry, clothing and other similar uses. 16-72-030 Bonus incentive permits.

The purpose of the bonus permit system is to encourage the development of property and for the creation of additional amenities by offering reduced restriction or permitting more intensive development. A developer/shopowner can earn bonus points by providing and incorporating certain design amenities into specific site development plan approved by the department of planning. After a developer accumulates ten bonus points, the required off-street parking restriction is reduced by one space. Bonus points may be earned according to the following urban design amenity bonus schedule:

16-72-060 Permitted off-street parking in industrial districts.

A.    Manufacturing, fabricating and processing plants not engaged in retail use are required to have a minimum of one parking space for three employees plus an adequate number of spaces for visitors and company vehicles operating from the premises.

B.    Warehouses and freight terminals are required to have one parking space for each three employees, plus an adequate number of spaces for company vehicles operating from the premises. (Ord. 2286 § 23.5, 1982)

16-72-080 Minimum required off-street loading standards.

A.    Buildings with a net floor area of less than eight thousand (8,000) feet shall provide adequate receiving facilities so as not to obstruct the free movement of pedestrians and vehicles over public right-of-way.

B.    Buildings with a net floor area of eight thousand (8,000) square feet or more shall provide off-street loading spaces in accordance with the following tables:

C.    When trailer trucks are required for such loading and unloading the space provided shall be sixty (60) feet depth, fourteen (14) feet (width) by fourteen (14) feet (height).

D.    No such loading space required in this section shall be provided in the front yard of any building or contiguous group of buildings.

E.    No loading area may be counted as parking area required in these regulations.

F.    Branch banks and other drive-in uses shall provide a minimum of four stack-up spaces per drive-in service window. No such stack-up spaces shall impede the access to customer parking or ingress and egress of traffic on to public streets. (Ord. 2286 § 23.7, 1982)

Article III. Design and Maintenance Standards

16-72-090 Access.

Each required off-street parking space shall open directly upon a means of access aisles, driveway or public alley of such width and design as to provide safe and efficient means of vehicular access to such parking spaces in compliance with the standards set forth in the State of Illinois Division of Highway booklet entitled “Policy on Permits for Access Driveways to State Highways.” (Ord. 2286 § 23.8(1), 1982)

16-72-100 Drainage.

All open off-street parking areas shall be pitched and drained so as to prevent the flow of water from such areas on to adjoining property or onto streets or alleys. (Ord. 2286 § 23.8(2), 1982)

16-72-110 Interior design.

Open off-street parking areas must be paved unless conditions warrant otherwise, such as lack of adequate storm sewer capacity. The decision to waive the requirements must be made by the director of planning and the city engineer. All parts of off-street parking areas which are unusable for parking or for traffic shall be paved or landscaped and continuously maintained. (Ord. 2286 § 23.8(3), 1982)

16-72-120 Lighting.

All parking facilities of more than four spaces shall be illuminated. Any off-street parking lighting shall be so installed as to prevent direct rays or light from shining on surrounding public and private property. (Ord. 2286 § 23.8(4), 1982)

16-72-130 Markings.

Required off-street parking spaces shall be so designed, arranged and regulated as to have individual spaces marked, be unobstructed and have access to an aisle or driveway so that any vehicle may be moved without moving that no maneuvering directly, incidental to entering or leaving a parking space shall be on any public right-of-way in a required setback. 16-72-140 Parking stalls and driving widths.

Each parking area shall provide painted parking stalls of minimum width and length and drive area of minimum width as indicated in the following table:

For purposes of measurement, drives with parking on one side only shall be considered as one-way drives.

16-72-150 Screening.

All open off-street parking areas for more than four vehicles shall be effectively screened by a solid fence or densely planted evergreen screening or combination thereof to a minimum height of four feet along any lot line which is adjoining or is directly across a street or alley from a residential district. 16-72-160 Wheel stops.

Parking areas shall be provided with bumper stops or wheel stops located so that no part of the parking vehicle will extend beyond the boundary of the established parking area into any required front yard, add side yards or into adjoining property. (Ord. 2286 § 23.8(8), 1982)

16-72-170 Setback requirements for off-street parking.

A.    All parking facilities except for single-dwelling residences shall set back from all public right-of-way lines in accordance with setback requirements of the applicable zone. Any parking abutting a more restrictive zone shall have the same setback as the more restrictive zone.

B.    Clearly defined driveways shall be provided for ingress and egress. Driveways shall be located or constructed subject to the following restrictions:

C.    Drives contiguous to the front of commercial structures shall provide an eight-foot painted fire lane, two twelve-foot traffic lanes and be separated from parking areas by landscaped aisles or islands a minimum of ten feet in width. (Ord. 2286 § 23.9, 1982)
