16-88-010 Purpose.

The purpose of the shelter care home legislation is to provide a residential setting for groups of developmentally disabled or other similar unrelated individuals, functioning as a family and residing as a single housekeeping unit, as well as protecting the quality of the surrounding neighborhood. The intent of this regulation is to provide a permanent residence and family environment for individuals who share a common need for group living, security, companionship, household needs and maintenance. Need is determined by a recognized sponsoring organization whose function is to provide services for a group of qualified individuals. (Ord. 2286 § 27.0, 1982)

16-88-020 General regulations.

A.    A shelter care home shall provide a live-in house manager to provide household services.

B.    The shelter care home will comply with off-street parking requirements as permitted in Chapter 16-72.

C.    The shelter care home will house any resident who may require medical consultation; such medical treatment will be made available whenever necessary. This provision shall in no way require constant in-house medical care.

D.    The shelter care home will conform, to the extent possible, to the type and outward appearance of residences in the area in which it is located. This provision shall in no way restrict the installation of any other special features required to serve disabled residents.

E.    To prevent concentrations of shelter care homes for the developmentally disabled and impaction of a neighborhood by a high concentration of such residences, care shall be exercised when considering an application for a special use permit for such residence which, if granted, would increase the number of developmentally disabled persons living in such residence beyond sixteen (16) persons within three-fourths of a mile radius of the proposed home. This provision is intended to assure that the capacity of a neighborhood’s existing social structure to accommodate such homes is not exceeded and that a concentration of such homes does not develop that might inadvertently recreate an institutional setting which would impede their proper functioning. 16-88-050 License required.

No person shall open, manage, maintain or operate a shelter care home without first obtaining a license. (Ord. 2286 § 27.4(1), 1982)

16-88-060 License application.

Any person desiring such license shall make application in writing to the city clerk. Such application must comply with the general provisions of this title relating to application for licenses and shall state locations of the proposed site for the shelter care home, its purpose, the manner in which it is to be conditioned, maintained and operated; the accommodations available for the residents thereof, the nature and kind of care; and any and all other pertinent information required to administer the shelter care home for which a license is required. 16-88-080 License fee.

The license fee to be paid annually for such license shall be a minimum of twenty-five dollars ($25.00) up to and included five dollars ($5.00) for residents in each shelter care home and an additional five dollars ($5.00) annually for each resident. If two or more homes are physically connected by a passageway for convenience of the occupants, each home, or building, so connect shall be considered to be a sheltered care home for licensing purpose. 16-88-090 Inspection.

It shall be the duty of the health department, the planning department and fire department upon presentation of such application, to make or cause to be made an inspection of the premises where the proposed shelter care home shall be located. (Ord. 2286 § 27.5, 1982)

16-88-100 Nonconforming uses.

Any shelter care home as defined in this title, now operating in the city, upon effective date of the ordinance codified in this title, under a rooming house or boarding house license shall be entitled to the issuance of a shelter care home license. Any such shelter care home shall continue to operate on the basis of a nonconforming use established as of the effective date of the ordinance codified in this title. In any event, any shelter care home under this chapter shall cease to operate or attempt to expand, or alter its operation in any respect whatsoever.
